So I was going to top up transmission fluid but been told from one person I have to vacuum the transmission fluid out then top up , and told by another person to tack pan off from bottom to empty it ... any alone know what to do ? Can I just top it up? I've noticed there isn't a dipstick just a cap ?

Take the car to an indy and have the fluid level checked. You can do more damage by overfilling it if the level is OK.
You also need the gearbox ECU fault codes read to see why the car stuck in gear.

Or read up some of the stickies in the Diy section here, under 'Engine, Drivetrain ...'

Plenty of auto transmission info there.

One thing to avoid is buying the cheapest ATF based solely on price!
- Mercedes auto boxes are generally high quality with an excellent reputation and require specialised skills to diagnose problems correctly.
- So do get it checked out properly!

As AMGeed says, take it to an indy with a good reputation - that's probably the cheapest solution in the long run.

Unless the engine revs and the transmission doesnt engage I would say its not related to fluid level.

The oil must be changed from underneath. Not from above.
