Bought the car at 6pm, broken down in a lay by 30 mins later CL63AMG

Hi all, after only 30 mins of picking up my CL63AMG AM am now stuck in a bus stop, 5 miles from the dealer after the dash suddenly showed "Drive to workshop without changing gear". At this point the gearbox started jerking badly and I had to pull over, in a bus stop on a hill, so thought it best to put the car into P. Well it wasn't till I whipped out my phone to check the forums that I found this was the worst thing to do. Car won't start, its dark and I'm marooned. :evil:
Called the AA who came and they've checked both batteries (inlcuding the one in the boot behind the rear seat) which were low voltage. AA plugged in their Bosch dial computer and got the following codes:

Engine control - 47C / Motronic ME 9.71433 - CAN signal from electronic selector-lever module.
Error Message : No communication.2017 - CAN interface.
Error Message : signal not in range.1405 - .
Error Message : Unknown fault.1373 - Brake control unit.
Error Message : No communication.trans fault low voltage, unable to start vehicle. Advised req investigation. Rec to garage if suitable.

AA guys believes the jerking gearbox are because the cars been sat around for weeks with very little use, therefore alternator hasn't been charging the batteries hence why the gearbox warning came on. I'm now waiting for my car to be trailered back home 35 miles away to get to to my local Indy. AA guy reckons alterntor is probably gone hence batteries low. He couldn't test the condition of them because the car wouldn't start.

Looking at the evidence and fault code do you agree or is the ISM knackered?

Am so pee'd off. 5 miles into cl63 ownership and the damn thing is dead by the roadside.:(

Did you call the dealer or were they closed?

It may well be from it just sitting around. Unfortunately cars do break down and this is a specialist car so make sure you are happy that it is a simple fault. If not, get a refund

Called the dealer and he made up some guff about sold without warranty and I should take it to a garage and claim it then he'll pay it back blah. I'm aware that sales of goods act means he has to do something whatever crap he comes out with, thing is how easy will be to get him to lay up without letters, CC judgements, small claims etc... can't exactly drive it back to him as the car is stuck!

TBH he sold the car to me t very good price so suspect he wants to avoid taking it back and paying for any work done. I've paid for it now and have to get it to an Indy/dealer to get the thing started. I suspect you're right Bob, it's not been used and this was going to happen who ever bought the car. I paid £250 for a full inspection and it came back with a full bill of health so accept its just one of those annoying things. Mechanical stuff goes wrong. More concerned about what problem is and whether I can get it sorted - I've got a Warranty Direct warranty so a duff alternator is covered.

Thanks Clive - now keeping warm in a chippy and chowing down on fish n chips - pretty sanguine about the situation cos life's too short and am hoping it can be resolved without much if any costs - getting stacks of told you so from my unsympathetic wife.

It's a teasing problem, it seems like the end of the world right now but once a few trips in it and your soon forget about this bad start!!

I'm sorry to read this, but I would have got the AA to take it back to the dealer and say something along the lines of sort it or refund me in full.

You're correct - you are covered under what was sale of goods act (can't remember the new name for it). You have more protection now than ever.

Good god thats awful...who did your inspection? Would have thought batteries were a fairly simple check, but as Colin says once this is all sorted and youre firing up and down the roads you'll soon forget the bad start....

Well the AA arrived - and guess what, put my key in the ignition and the warning light has gone out and the car started! The warning light came back on shortly after so have dropped outside my Indy for a full star diagnosis and see where we are tomorrow. Will let anyone whose interested know tomorrow.

It's at Eurocar Care in peterborough - Ram the owner is pretty good and I've used him before. Am hoping you're right it's duff batteries or a flaky alternator. Suppose I should've have used my instinct before buying a car that's literally only done 800 miles in the last year. No doubt Warranty Direct will find some excuse not to pay out like they all do.....

consumer rights act 2015 , for 6 months from date of purchase the buyer is entitled to reasonable repair / refund or replacement of said goods

my 216's battery was screwed when I bought mine but after it was replaced the car drove without issue so I'd be surprised if this is just low battery voltage to blame , we shall see

Update

Well cars been on Star and a whole raft of CAN error codes have come up. Jay at Eurocar care suspects it's all battery related so they're going to stick it on charge over the weekend then start discounting problems one by one. No ISM errors so don't think it's the gearbox giving problems. Ironically car started first time this morning and no errors came up. Also told them to check all lubricants and change any that they think are past their sell by date. I'll let you know what happens next week.

As for the dealer - yes I could engage in a fight with them and take the car back, leave it with etc but can I be bothered with the hassle of driving 40 miles to another city, arguing etc, leaving my car with them and expect them to deal with it now? No basically - my instinct says a quick resolution to my satisfaction is unlikely. Want this car working and in my possession so going to sort it myself first. If we find a major failure and the warranty doesn't cover it then we'll have another conversation.

Hi- are you saying you think it could just be a battery problem or are you saying you think it might be a more sinister ( i.e. Expensive headache) one?

If it's only done 800 miles in a year perhaps it just needs some love.:(

Sounds a pragramtic approach....

Could i suggest that you let the dealer know what you are doing, and once any costs are paid for with your Indy, call him and politley explain the situation and ask if he would like to consider what he feels is an appropriate offer from him in light of this. And leave him a little time to think it over, no rush...

If he is capable of selling prestige cars like this, then he may surprise you and make a reasonable offer and in light of the good price you paid, you move on and enjoy the ride.

It worked when I had the same issue with my first MB and I walked away happy enough

no , im saying what I experienced when I bought my 216 pal , a flat battery didn't equal loads of gremlins , but each car is different
