Cars on the pavement.

Isn't pavement-edge parking legal if there's a local by-law permitting it and conversely illegal if the local by-laws ban it?

I recall a few places where authorising signs show a picture of a car with the wheels on the pavement - but only taking about 1 x foot or so. I think the council comments quoted by anglaslt is the usual load of "I'm too busy jobsworth" because they are the ones who issue the by-laws and they could allow or ban pavement parking anywhere if they got off their posteriors!

We've had a new build nearby, set back from the main road and like all new housing they are crammed in quite tight so it will be interesting to see what happens and how soon - it will be visible to all passing by one the main road. But the residents deserve some sympathy because there's an obvious problem even before more than a few have been sold i.e.: the lack of adequate parking space allocated to each house. Most couples nowadays have two cars; if they have kids, as soon as they reach 17-ish there's a third car to be parked and so it goes on.

A few years ago, I saw a policeman putting penalty notices on a row of cars that had a wheel on the footpath at the seaside village of Ingomells, Lincs. I had a look at one of the notices, and it said an offence had been committed of `obstruction of the footpath`, but there was still room to walk on the footpath.
There may not be a law against parking on the pavement, but yes, obstruction would be the charge :)

Certainly round where I live with some very narrow residential streets and roads there is barely room to get one car down the road let alone in both directions, unless people park partly on the pavement and sometimes on both sides of the street.

Around here cars park half on the pavement on double yellow lines..
Maybe twice a year the police will have a ticketing session, but that's only because they have been called to another incident locally and seem to do the tickets out of some sort of act of revenge..
Our council is trying to get something changed so they have the power of street parking enforcement.
It does seem fines only get dished out when its easy prey and no chance of the owner appealing..
Other areas that say unloading or max of two hrs get ignored and is totally abused by locals !

The Highway Code says: "Do not park partially or wholly on the pavement unless signs permit it".


Under section 19 of the Road Traffic Act 1988, Heavy Goods Vehicles are banned from parking on the footway, although the section is subject to a number of exemptions; in particular an HGV may be parked on the footway when loading/unloading is in progress.

Some urban Local Authorities have adopted powers (through Local Acts) to prohibit parking on footways and verges throughout their areas. This prohibition is usually indicated by signs at the boundaries of the urban area. However, there is no national legislation prohibiting the parking of all vehicles on footways and verges, due to the wide range of circumstances where footway and verge parking occurs; in many cases because drivers have little option but to park on the footway or verge in order to avoid causing disruption to moving traffic.

Parking of cars partly or completely on the footway can be authorised by Traffic Regulation Order. There is a need to ensure that adequate width of footway is retained for pedestrians, particularly those in wheelchairs or with perambulators.

Note something is missing from the discussion - sufficient room for a fire engine to get through the gap when cars are parked inconsiderately, especially on new developments where there are few parking facilities and narrow older areas where the car wasn't around when the houses were built and cart tracks put in.

A bil is a fireman who can drive anything in operation, he gets annoyed when people die as he couldn't get through the non existent gap to get there in time. The paperwork to not meet the attendance targets is a pita. But hey, someone got a space to park their car so as not to walk a few feet :shock:

The street where I currently live is so narrow when cars are parked that a fire engine could not get onto it. Would have to park at the end of the street and run extra long hoses.
