Some of you may recall my long running dispute with Mercedes-Benz Chelsea,
well, I am back with a new story about my efforts to persuade the Metropolitan Police Service to investigate my complaints.

Before I post I would like to ensure that I am not breaking any forum rules.

I sent a message to admin, but, their box was full.

Well, where do I start?

OK

In 2010 I went to Holborn Police Station, London, to report named persons from Mercedes-Benz and Mondial.

The first thing I was told when I asked to see a police office about my complaint was the civilian worker after hearing the nature of my complaint repeating parrot fashion; It's a civil matter, its a civil matter, its a civil matter.

When he finally stopped I asked for a police Officer and as I was not going anywhere he fetched one who said, yes, you've guessed; its a civil matter, errr, not its not ,so after a while he fetched a Sargent, who listened and accepted my reasons for the complaint of Conspiracy to Defraud and Conspiracy to Pervert the Course of Justice.

I was told that a very senior Office would look at it and come back to later that day.

They did so and I was given a crime number.

I went to an interview at Notting Hill Police Station where a Detective Constable Tracy Obasi interviewed me. By the time I left the station I felt that I was at last getting somewhere.

Errrr, no

The little minx told me that the police would be obtaining the trial transcript
to confirm the considerable amount of evidence I had left her.

Six week later she sent me an e-mail that the transcript had been transcribe and she would look at it when she returned from her annual leave.

When I enquired some weeks later on how the investigation was progressing I was told that she had "lost" the transcript. I thought to myself "the police are not telling me porkies" are they? Umm, yes they were.

I contacted the County Court and no transcript request had been received from the Met.

When I inquired about this apparent discrepancy I was informed "the case is now closed".

The same day,coincidental Guy Fawkes, I officials complained about her conduct and that of her supervisory Officer, Detective Sergeant Kidd.

Well, thing certainly became interesting then as I went further up the greasy pole.

The tally grew to include

Detective Chief Inspector Helen Williams

Superintendent Rose (Alleged Malfeasance)

Sir Bernard Hogan-Howe, Commissioner for the Metropolis (Complaint registered with the Mayors Office for Policing and Crime.

There were a few others, but, they retired.

I had to go to the High Court a few times, but, when Lady Justice Hallet, one of the most Senior Judges dismissed one of my application with the comment

"your remedy is right, but, your application wrong", I stopped trying to use the law against the police.

There is a gem called; ex parte Blackburn which means that the police do not have to investigate any crime that they do not want to

I have become very familier with the Police Complaints procedure and the Independent Police Complaints Commission.

I've not posted on this forum for a long time and followed your previous issue with interest.
I must say though I think you have been incredibly foolish naming various police officers involved on a public forum.
You may even have committed an offence.

I'm impressed at your finding so much time to pursue these matters, having the life I have I wouldn't be able to.

Only serving Officers. With the number of laws on the statute book I might well have. I'll take my chances and hope they have a sense of humour.

I would willingly name the persons at Mercedes-Benz and Mondial, but, I do not wish to cause any problems for the site. The named are available by request.

Mercedes-Benz, Mondial and the Metropolitan Police Service have been taking the p*** for eight years now, so its my turn now.:lol:

This is where the wonderful;

R v Metropolitan Police Commissioner, ex parte Blackburn [1968] 2 QB 118

becomes so very important.

This ex parte Blackburn leaves all operational decisions to the Chief Constable/ Commissioner of Police for the Metropolis

So what's the complaint about then?


On the 30th November 2005 my S500L was recovered to Mercedes-Benz's workshop by transporter.

In January 2006 MB wanted £6,640 for the vehicle repairs as they maintained that the damage was caused by "you or somebody know to you".

At the time of asking MB were in possession of a report from the recovery company stating the the car had been driven into the workshop parking area.

In the Court, MB's Barrister admitted to the Judge that I was not responsible for the damage to the vehicle and I was awarded Judgement and Costs.

Then it really became serious.

If its part of an ongoing investigation or could be, it is potentially dodgy given allegations being made.

Not only that, it could be defamation.

I believe this went to the high court as Robert stated, naming people involved maybe an offence.
Now if your qualified in Civil Law then I'll stand corrected.

Having some experience in this area :rolleyes: I read these posts with interest.
The general publics ignorance of the law is frightening,
but if you have never found yourself the wrong side of proceedings maybe that is understandable.
One snippet for the general populace is a Judge in a Civil case makes their own decisions as to what is significant or not,
So you may stand in court with the Pope as your expert witness on Catholicism but if he/she doesn't want to take any notice, tough.
