E350 (A207) Convertible roof frame problem

I have watched this forum for ages and learned a lot, but never had need of it before. Now I am in trouble and i hope that someone can help.
I bought the E350 about 6 months ago and love it. It was a Mercedes approved used vehicle so has warranty.
About a month ago the battery failed. Fair enough, Sytner in Weston changed it no problem but then told us that a technician had noticed a “dent” in the soft top which they thought was some sort of structural failure caused by an outside force and not warranty. They can fix it....new hood,,,£9000!!!
Unfortunately I am in Canada until Christmas so my poor wife is trying to sort this out. She has taken it to a local garage who have identified a plastic strut that has broken.
We are not aware of anything that has happened that could cause this and i have a sneaking suspicion that this might not be a one off.
Has anyone ever come across this? Any help welcome

Hi John,
I purchased an E220 Convertible (Approved used 9 months old) last August 2017, my first experience of a convertible.
Have been very pleased with the car .
I always had a mechanical clunk whenever the roof locked up or down.
As it happened on the demo I never had any concerns.
With it being a fantastic summer , that roof had plenty of use. Not that it should be out of the norm for a convertible intended for warm climates & a car less than 2 years old.
Unfortunately ,one morning I retracted the roof and found it would neither close fully or open fully.
Road side assistance came and were also unable to close and secure the roof.
On investigation, the dealership identified bent rods and migrated bearings, the roof had distorted and a full roof was required.
I am now 11 weeks of driving a courtesy car ,(Thank god for warranty)
I am trying to get a resolution to this but am advised there is a back log for a replacement and I have no end date to rectify this problem.
This back order delay would suggest an inherent fault in this model.
I also suffered a steering control unit fault that inhibited selection of any gear, that resulted in a control unit replacement,
once again thank fully under warranty.
I am currently in contact with the Citizens advice in relation to the consumer act of 2015 .

Thanks so much for your reply. This car was 2.5 years old when i bought it with 25,000m on the clock. We have had a few problems. The Ad-blue one springs to mind. There is nothing in the handbook about where the tank is or the filler or the procedure. Apparently the ignition must be ON when refilling but thats not told to you anywhere.
I digress. The strut that has broken is not easy to get to apparently and the Mercedes dealer were adamant that they had never seen this before and it must have been due to an "external" force. I dont believe a word of it. My wife is going to take it to a hood specialist and get a report. £50 well spent i think. Very worst case is that I get a new part fabricated/3D printed and repair it. I was just outraged that there seem to be no proper engineers in car dealerships now. The attitude was, its failed (dont know why but it cant be "our" fault), no parts available, frame not available separately, £8000 please - oh yes and you can probably claim it on your insurance... I mean I may look like a moron but.....
I am going to email them today to get them to contact MB about this and ask for history of similar failures. I dont give up with these things and i am really annoyed, i can feel the small claims court coming on.....

So after 3 1/2 months of waiting , I finally am told my car is ready for collection.
On test the roof still makes a loud clunking in opening and closing .
Neither the Service rep or workshop technician are confident in the operation so its gone back for further test/adjustment.
As I pointed out that if it takes 18 months to fail again I will be out of warranty and landed with a hefty bill.
