Mercedes-Benz has sent me the latest copy of "Mercedesmagazine" for my enjoyment. Given my legal action against them it was a very generous gift.

I am surprised I have not been deleted from the mailing list!

I am using the advertisement on page 77 to claim £3,000 from MB at the Small Claims Court. Loss of a FMBSH.

I quote;

It's official. 9 out of 10 customers would rather buy a used Mercedes-Benz with an Official Workshop service history.^


^ This is according to a survey carried out on-line December 2008 to January 2009; 97% of respondents (3,583 people) indicated that they would prefer to buy a vehicle which had been serviced at a Mercedes-Benz Official Workshop than at an independent garage, assuming the vehicles were identical in every other respect.(end)


So now you know, I wonder who the 3% were? Now if MB had posted the survey on this forum would the numbers be the same?

So, to sum up; I have lost the Mobolife and now, it would seem a FMBSH, unless, of course MB serviced my car these past four years. I must ask to see the service print out!

I have three Claim forms being processed at the County Court and I am open to further suggestions as long as the sum Claimed does not exceed £5,000.

In your position I would put this all behind you and move on. There comes a point where getting on with life is more important than proving your point.

That would be true for a lot of people, however, as I am semi-retired now after working since 1962, I thought I would be able to enjoy a car I have always aspired too. Mercedes-Benz have scuppered that dream so, this is the next best thing. Without Mercedes-Benz I would not be attending the University of London, Birkbeck, to study for a Law Diploma. A very interesting course, much better than philosophy course although, the logic of argument module was intellectual stimulating.

I object to an organisation like Mercedes-Benz lying too me, call me "old fashioned", but, there you are. In all the years I sold cars new/used I never found the need to blatantly lie to a customer nor in my other business's.

What I find particularly annoying was the fact that Mercedes-Benz thought they would "get away" with it! All I ever wanted was my car returned too me,
repaired as per the Warranty, was that too much to ask for?

Well as your study of law goes deeper, I am sure you will find there are many cases where one persons view of events is very different from the other persons. And that in many cases finding proof of who did exactly what is not either easy or sometimes even possible.

Sometimes it pays to move on rather than waste a whole chunk of one's life immersed in the bitterness and anger of a prolonged dispute -whoever was the more in the right.

There is a danger, that you could end up so far up your own arse, it would be difficult to continue to enjoy ones retirement.

I hope your not showing symptoms ........... and that the course being attended has a wider use, and brain stimulus, than the ones showing.

It's worth pointing out, that you are emotional............ and not one Mercedes employee will see your court actions, and correspondance, as anything other, than work !!

Thank you for your reply. The thing is, I am not bitter or angry about this whole sorry drama. I have had a lot worse happen too me than MB trying it on.

The medical "profession" almost killed me a few years ago, in fact, my then wife was told I would not survive, god was she ****ed when I woke up, I was worth a fortune dead. The medical team were none to please either when I informed them of what I thought of the care I had (not) been given, so, to sum up, once you have come back from the dead you have a whole new attitude toward life.

I trust when this is all over MB will be more careful dealing with damage to customers cars, but, then again, perhaps they won't, who knows.

Symptoms, what apart from being Bi-Polar, no, the medication takes care of that.

You are quite right when to write "and not one.....,than work.

However, I have one last surprise for Mercedes-Benz and hopefully I will not have to use it as I do not wish to be vindictive. All I want is my money back,
or a replacement car of the same value as at November 2005.

The Law course is a joy to attend and the next module, business Law should be very informative. :D

Problem is that companies and agencies have utter contempt for civil law as seldom they come across people like yourself who are prepared to take them on.

And i will say one point to the people who think nothing is worth a fight,

Rights that we all enjoy have never been given by some nice guy at the top they have always had to be fought for by people like Robert.

Seems to me that the care was pretty good, as you recovered from something you weren't expected to.
In your place I'd be thanking rather than complaining.

Err, no. Double pneumonia and a pulmonary embolism was the result of poor care. I was in hospital for treatment for my brain tumor,a Macroprolactinoma.
God only know how long I was unconscious in the toilet, but, my right hand was blue through being crushed. Its all in the past now, life goes on!

I'm entirely with you there Don. There have been many occasions when I have taken the alternative view and ended up in "me versus the world" situations. The world has done a bit of learning over the years, and it is always gratifying when people eventually see sense - just because they did not think of it, or see it that way, does not mean that it is not so.

On a second point, as a member of the medical fraternity, let me assure you, if I ever tried to kill someone, they would not be writing about on a Forum.

But finally, I guess it has to be said that there comes a point in any campaign when you need to review the art of the possible. We do not know the full story in this case, but there are as always two points of view. The difficulty is that the more you entrench yourself with one set of arguments, the more impossible it becomes to see the other view.

I would not defend an arrogant corporate entity which relied entirely on its size and the inertia of the legal system to bludgeon any dissenters. That is why the law exists, and it should be fully tested before accepting the outcome. But at that point, the outcome must be accepted in order to enable moving on.

Sadly, the law and justice are not always synonymous. And the law and commonsense need not be synonymous either.

To be effective, justice should be prompt, transparent and fair. That is why flogging was so effective in the Royal Navy. Sadly, we have bureaucratized the process now, so that prompt and fair may be casualties. Transparency suffers too.

Now, did I put that writ?

I do not give up, its a terrible failing, but, I am what I am!

Between issuing Claims against MB I am about to "take on" Camden Council who in there wisdom sent a Penalty Charge Notice for "an alleged breach of a Bus Lane order.

There are so many breaches of the Order I do not know which one to go for;

No warning sign

No road markings

Incorrect lane, solid line access

Bus lane suspended sign showing

Choices, choices.

Camden have seven days, then I will be back to the County Court and issue a claim against them.

How many motorists have been caught and have just paid up?

Theobald's Road has three "separate" bus lanes, two 7-11 Mon-Fri and in between them a 24/7 day, so, miss the sign, just behind the large plane tree
amongst all the others and you are down £60!

I knew my law course would come in handy and not just for Mercedes-Benz.

Photographic evidence. I have had results when "nicked" for disobeying illogical signage at the cross roads of Putney High Street and the South Circular, and on a separate occasion beat a parking ticket where the signage was deficient (different rules on either side of the road, but no signs on my side to make that clear).

In both cases, photographs spoke for themselves and I was "severely let off" and advised not to do it again. The signage subsequently improved on each venue!

I'm guessing it is a pituitary tumour producing a hormone which stimulates milk production - unhelpful in either gender, quite unwelcome in men.

Quite right, I had more female hormone in my body than a milking Jersey cow.

The side effects were really something else!

The cure was horrendous, which is how I ended up in hospital and even now when I take my weekly dose to stop the prolactin production it is 30 hours of
great discomfort, every week, year in year out.

So, the Mercedes-Benz saga is a "nothing" compared to what I have been through.
