Who knows Mercman ?
We are in a good position with sales of goods act, as it’s been proven it had a bodged repair before our ownership.
But with court cases it can go either way.
+ To take court action will cost £500.

Not easy , then there is the time factor if it goes to court as well. stressful.

Not easy , then there is the time factor if it goes to court as well. stressful.

Very true, but I very much doubt the garage we purchased from are going to cough up £1800 without a fight, they have already paid half of failed repairs to date.

I suppose your decision depends as well if any other cars of the right spec/price are out there ?

Been on AT over last day or so Wighty and there’s not many.

That might help you with the decision then ? Especially if the car you have now is a perfect example (apart from the upcoming fix )

That might help you with the decision then ? Especially if the car you have now is a perfect example (apart from the upcoming fix )

And I Ceramic coated it !!! :D

Well after thinking about it we have decided to get the roof replaced and not go for a refund.
The Big call is going into the dealer on Wednesday, as the owner is away.
I’m not messing with him I’ll give him the opportunity to settle the bill with MB Milton Keynes, or we will see him in court.

Well after thinking about it we have decided to get the roof replaced and not go for a refund.

I’m not messing with him I’ll give him the opportunity to settle the bill with MB Milton Keynes, or we will see him in court.

Possibly use the "reject car" as option 1, with a view to the correct fix as option 2 being acceptable to you, which I suspect would be the better option for the supplying dealer chap?

Update....
Just had a conversation with previous owner on log book, I wrote to him a couple of days ago and to be honest didn’t expect a reply, when I mentioned we were in a dispute.
He confirmed car leaked when he had it, and is one of the reasons he sold it !!. To we buy any car .
I can’t see there is any way now that the supplying dealer can get out of this.
Funny thing is just looked on his website and he has another SLK 172 same year up for sale, I hope for his sake he’s checked the roof throughly.

more to come I’m sure....

Update...
Well call has gone in to Director, I think it went ok, and I made him fully aware of consumer rights act 2015, and the fact we have 2 independent witnesses statements.
We have given him 7 days from today to discuss with his other Directors,
Which he did ask for.
My gut feeling is he will come back with an offer of some sort, maybe 50% contribution, but even though this would be a step forward, we would still need to spend £800.
Any comments/ advice that you good people may come up with would be much Appreciated.

But I fail to see how it would be Betterment as you put it ? We only want what we paid for. (IE a vehicle that is fit for purpose)
I believe if this went before an insurance company they would wright it off.

I feel your pain on this but the car is circa 10 years old and in my book all cabs and retractable roof cars will have problems at some stage. The dealer in all fairness has accepted responsibility and part funded a MB repair which is where the problems really started it would have better to have replaced the faulty roof section instead of attempting a repair especially as MB stated it had been bodged so in my book you and the dealer have been victims of poor advice. If the car is what you want in all other respects certainly worth spending the bit extra and hopefully get at least a years warranty on the roof repair

Just my halfpenneth!

It’s always difficult for dealers to turn away a repair but that would have been a better outcome as MB felt it wouldn’t resolve the problem and they’ve covered themselves by making that statement. In view of what you’ve said it does look like the seller hoped the repair would last long enough to cover their warranty and the gamble didn’t pay-off so I agree with you the onus is on them to sort it out. Hopefully they will do the right thing but still feel they will want a contribution from you, obviously you can refuse and see where it goes from there....

Hope you get a speedy resolution especially as it’s your wife’s car
