Emissions claim? Is it genuine?

I'm being asked to claim against MB because of false emissions data they gave when I purchased my GLC 250d. The lawyers representing claimants work on a no win, no fee basis. Has anyone done this successfully? Is it for real or a scam? What's the small print/risk in making a claim?

Rife in society at this moment- often with VAG group 'customers'. It's the next PPI gravy train robbers using a shotgun approach to their market. Sorry I don't know of anyone who has either gone down the route nor therefore any success. I'm naturally dubious

From my understanding, MB are obviously going to defend the claim rigorously. A few law firms are currently trying to get clients on their books on the NW/NF basis.
The biggest one IIRC is in London and there commission if successful is......wait for it.......50%!!

Nothing is guaranteed if the underwriters in the event of a no win situation don’t pay out the claimants will be liable to pay costs awarded - that’s how I read it but then I’m no lawyer - needless to say I’m not making a claim

That's also how I read it. So the potential risk to claimants is huge.

I'd be very very careful with these no win no fee contracts. Read the whole contract very carefully before signing up. The last two I have been shown made it clear that in the event of losing, the client could still be liable for what would have been the lawyers "success" fee (20% of the awarded costs) but limited to the amount of their ordinary fee (at up £400 an hour). You can imagine what these costs would be in a US style class action type situation.

You are right. That's what I read in the "small print." Perhaps the term should be changed to No Win, No lose (for the lawyers).

Be honest. When you bought the car did you consider emissions at all for one minute.? If not...where is the morality in claiming. If, you say, yes...then beware, as already suggested, of the small print.

Actually we did, in the sense that we looked at all the data. Having the ad blu was also a convincing factor. But the claim looks very iffy.

It's some legal firm that's watched the VAG story, and thought, "We'll have a bit of that and make our name!" It may as well be a scam, as far as I'm concerned - ambulance chasing strikes again!

As said above, how many people truly buy a car based on emissions? They may look at the various tax implications, sure... and that hasn't changed for the owner.

Yes they do, clearly, how much are you penalised with your Car Tax for the nasty emissions you produce in your choice of vehicle?

ps was it really the environmental factors which make them chose diesel - or the thought that they will get 50mpg? (Saving money) and cheaper road fund tax due to wonky emission data (saving money)

my comments were a bit tongue in cheek (emoji) so don’t get too wound up :cool::)

The move to Derv by politicians/manufacturers certainly provided a dilemma for most including me when choosing a vehicle, when I bought the S212 the ratio of diesel to petrol cars was 50/1 so some chance of finding a petrol vehicle with those odds which is why I ended up a OM462 diesel, I had a choice when I bought a 4 series and chose the petrol N55 engine and my next estate will be a petrol as more are available.

We all have to admit though that the low torque characteristics of a diesel engine suit modern stop start motoring they are quite addictive in that sense and I’ll miss that.

I would imagine that most people had heard of the dangers of particulate pollution (PM), Clarkson was banging on about this 30 years ago but politicians know best and we are where we are, few people at the time realised how toxic Nox would be though which has ended up being the spear through the heart moment for diesel engines

Absolutely correct LK. However the government now has a problem with the low/no road tax cars, loss of income.
So expect to see a change in the road tax charges of electric & hybrid cars soon.
