It’s always difficult for dealers to turn away a repair but that would have been a better outcome as MB felt it wouldn’t resolve the problem and they’ve covered themselves by making that statement. In view of what you’ve said it does look like the seller hoped the repair would last long enough to cover their warranty and the gamble didn’t pay-off so I agree with you the onus is on them to sort it out. Hopefully they will do the right thing but still feel they will want a contribution from you, obviously you can refuse and see where it goes from there....

We have discussed possible outcomes, and come to the conclusion
75% from dealer would be acceptable, and avoid court action.
Especially as previous owner is on board with us that fault had been present long before our ownership.
