ML 270CDi 2001.
Seen a few airco problems in the last few weeks and now I seem to have one too, I had mine re-gassed about a month or two ago, at first great nice and chilly out the events, oh by the way 2001 270CDi in and ML environment. Now I seem to remember reading somewhere that most MB compressors and now full time and no longer use a clutch, this seems to be borne out when after my refill switching on the airco produced no discernable reduction of revs which is what I get in my Toyota (still has a clutch) so away I go happy in the knowledge that according to the grease monkey there were no leaks in the system and it had been regassed to perfection. So once a week I diligently turn it on for a short while to grease the circuit so to speak, now it doesn't seem to be cooling much more than hitting the fan at full speed. It is just marginally colder than opening the window at 50Mph.

Is there a known weakness in the ML163 system, could someone be able to direct a finger at a possible culprit please. although confused I am not getting blue with cold.

Have you actually measured the air out temps?
A lot of these threads indicate similar problems with little more evidence than it no longer 'feels' as cold.
Remember it only feels cold if the ambient is warm.
Now summer has gone and it is much cooler anyway, the air coming out is going to feel the same.

Get yourself a cheap thermometer, and then you can measure it and know for sure.
I have seen cheap ones in Lidls for a few pounds.

However this is all assuming it was re-done properly and not another leak

Having seen the quality of some of the aircon "specialists" work and lack of actual refrigeration knowledge out there I am sceptical of the 2 minute leak check and refill carried out by some of these outfits.
The modern all-in-one machines are all well and good but unless the leak check is carried out properly then you may as well just dump the refrigerant into the atmosphere.
When I was working towards my refrigeration qualifications we were constantly given dire warnings about the mega fines handed out to anyone caught releasing CFCs into the atmosphere.
I took my previous car to one of these places for a leaky hose change and the first thing they did was to undo the hose and let the remaining gas out. When I queried him about reclaiming the charge he just looked at me blankly and shrugged his shoulders. He then renewed the hose, vacc'ed the system and refilled in 5 minutes. So any other leaks would not have been detected.
Time is money I suppose and who cares about the ozone layer?

My sentiments exactly.
If they cant be bothered with, what else cant they be bothered with?

Probably why, amongst other horrors, I had a wheel literally fall off once after they changed a tyre.
And why I will never go near one again.
