1999 E240 Classic with triptronic gear box 146,441 miles on clock

From start moves up gear box as normal then after 1 or 2 miles jumps in to 4th and stays there but if I put it in to cruise it immediately goes back in to 5th when take back out of cruise it jumps back to 4th. When I use kick down it sticks in third but same again if I put it in cruise it immediately goes back in to 5th and if in cruise on hills it goes up and down gears perfectly. ABS and Bas light comes on intermittently and records 3 faults if I stop and switch on again it works all right. I have had car at local M/B garage but the can not come up with any answers also had it at autmatic gear box specialist but want to strip gear box at considerable cost
its driving me nuts

Transmission woes

If the box shifts OK when in cruise then logically the box is OK and the control mechanism (which I assume is electronic) is screwed up. I'd certainly dismiss this as a possibility before rebuilding the box as (a) it'll be cheaper and (b) you will be more than somewhat ****ed off if you dump £1500 into a gearbox rebuild and it's just the same after it goes back together again

Certainly sounds ECU / sensor related rather than mechanical. I just wonder whether the speed limiter is getting involved somewhere. it can trigger downward gearchanges to slow you up and being on the same stalk as the cruise I can't quite make a connection as I don't know enough about how it works.
I also wouldn't rule out a connection with the BAS/ESP warnings. They are all interconnected so one could cause another to misbehave.
