Hi Guys.
I would really appreciate if you can give me a bit of advice on this issue;
I had an accident (Front nearside, also slid into a side wall hitting the back nearside wheel as well) in end of Jan 2013 and the car was promptly taken by the insurance company to their designated garage (nationwide repair) for the repairs. After 4 weeks I got the car back only to notice that the roof has completely stopped working. Apparntly the headrest were not going down which was preventing the roof to come down and after a quick research I found out that due to going over speedbumps or impact the rolling bar goes up which prevents the headrest to go down, BUT the garage was adament its most probably the switch to blame. And they will not carry out the repair as they dont think its connected to the accident.
Now I had my car in for some work on 21st Dec 2012 and MB dealership were kind enough to do a full inspection and no where it was mentioned that there was any issue with the roof, and also have pictures of the roof down as I purchased the car in early Dec.
After explaining this to the garage and insurance company they agreed to take the car back to fix the roof, but after a week I got a call back from the garage saying 'we have the roof working now but its not going all the way down and has to be manually pushed in, and since we dont think its connected with the accident we will not proceed with the repair'.Spoke with the insurance company and they are saying the same thing.
Now If they had to come back with the same reason after 7 weeks, they could have just stuck to their position in the first place, but they took my car back and made an attempt on the repair. Half way through the repair, they realised it will cost too much so they abandoned it and are asking me to get it fixed myself.
Any advice or guidance on how to proceed with this matter will be much appreciated !!!
