I'm considering a convertible and really prefer a 4-seater, 6 cylinder. With Mercedes the choices aren't many, and they all have fabric hoods. With BMW 3 series I can choose anything from 2007-13 and have a good choice of colour (don't want black in or out) and a metal top. The car has to stay in the street and with a soft-top I'm worried about vandalism and, to a lesser degree, durability. Never owned BMW's and am curious about what i might discover. Also wonder how it compares to my previous CLK in terms of driving position height - which was just about as low as I'd like to be from the road. Thoughts welcome.

Never apologise or show weakness buddy  . Test drive both , see what you think then tell us .
If you are over 40 and believe that indicators are a useful fitment then get the Merc , otherwise get the other one :D

For what its worth I have owned 2 & driven loads of BMW's, more of a drivers car but not as comfortable.
I didn't like BMW's service dept I fell out twice with them, but I have always had good relations with my MB service dept.

Can’t comment on the convertibles but I can give you a fair view from both sides

I have had two 4 seater convertibles. One tin top and one rag top. As far as the roof is concerned there are positives and negatives for both.

The tin-top is more secure and not susceptible to vandals but the one I had, the V Eos, leaked like a sieve and although the car suited me at the time I just got so pi$$ed of with it leaking I had to get rid of it at any cost.

The rag top was a BMW and didn't leak at all. The only criticism was the constant movement sounds while driving with the roof up. The interior of the BMW was quite depressingly dull too. What finished the BMW off for me was the fact that some ar$hole decided to slash the roof. So that was the end of my Convertible experience.

You can see by my cars that I have both brands and have had my share of both in the past - they are both great cars, they all have their pros and cons - depends what you are after - in my experience BMW costs more to maintain but that may just be me - they are much more enjoyable for spirited drives especially the ///M cars and are really very good if not the best sports saloons available bar none - even AMG & some super cars cant match the driving experience of the best M cars, where as Mercedes are much more refined, laid back and no matter what any BMW fan including me says, nothing can match the luxury of a Merc or the feeling you get driving it sensibly, its royalty on wheels.
