Diesel Software Update - CLS 350 CDI BlueEfficiency (2011)

Hello all, I know there are quite a few threads out there about the diesel software update but I just want some advise or pointers really.

So I take my car to be serviced to my nearest main dealer roughly 30 miles away, each time I take it in I tell them not to do any updates to the car, the only update I knew that was outstanding was this Diesel software update.

Anyway about 3 weeks ago the car went in for it's scheduled service and again I mentioned not to do any updates, so I get the car back and now I've noticed it's a bit more thirsty than usual, as I was suspicious if they had done the update I didn't want, I went to check on the site (https://www.mercedes-benz.co.uk/passengercars/being-an-owner/total-recall.html) to see the status, what do you know the Diesel software update has been completed, without my permission and I even said not to do any updates to my car. I've always seen it as outstanding.

So where do I stand with this, would I be able to get any sort of compo as I know they wont be able to put the car back to how it was and my only other option is a stage 1 map, which I don't really want to do. Not really happy about it, they've basically gone behind my back or just disregarded what I said and done the update.

Sorry for the long winded post, and again I know the subject has been discussed many times. Appreciate any help or if anyone has past experience.

I'd be complaining very noisily to the dealership.

The fuel consumption should return to normal given time as the car learns it's new parameters again.

More dirty oil and less efficient , just moves it elsewhere.

Unless you have written evidence and their understanding of your instructions it's as simple as your word against theirs, unless you can get them to admit it, which will be just consigned to the 'misunderstanding' category in any 3rd party evaluation.

I know it doesn't help you at this stage, but I went to the lengths of insisting upon written confirmation they wouldn't apply the update unless they provided further full replacement guarantees of all emissions related functions and sensors for a 12 Month period and received the below in return, the instruction was also repeated on their worksheet I signed when they came to pick up the car. I wasn't aware of the Service Recall check site and looked for my record to confirm the emissions update was Open, but also found another I wasn't aware of, a Takata airbag needs replacing so I'll need to get that seen to,!

I had the same thing happen to me last week. I am furious. The car went in to Inchcape Oxford for a coolant issue and came out with an emissions update which has ruined the MPG and lowered the power. An update that I was not told what it was for, and they never asked my permission, which would have been refused. I am now seeking compensation from Mercedes direct. They have no right whatsoever to update anyone's car unless permission is given. If it was under warranty then yes but this car is not. It was running fine returning good MPG with reasonable power for the E220 CDI. It has lost power and around six MPG less. I suggest you give Mercedes direct a call and make a complaint. It cannot be reversed so want compensation to have it remapped to it's original condition by private remap company. Inchcape Oxford claim that they have a mandate from Mercedes Benz. Well in future I will go to an Independent Merc specialist.

Yes exactly my thoughts 'Voluntary'.

My MPG is now very low and really am considering getting rid.

But first I will be talking to the dealer tomorrow and see where I stand with any sort of compensation towards a map or even doing the update without permission (This would be my word over theirs, and would probably lose that one as previously pointed out).
I highly doubt I will get anything tbh but worth a try.

Will keep you all updated on what I get back!

There are a lot of forces at work here - MB state the emissions software update is voluntary but the dealer will get paid for doing the update so has an incentive to do so - I think Tony #6 has the only surefire way of making sure there is no misunderstanding and the software isn’t applied to the car. Last time I took my BMW to the dealer for a service I asked for just an oil change and the car came back with oil change and cabin pollen filter (just a misunderstanding) well I won’t be having another ‘misunderstanding‘ with them

I signed off a work sheet for the coolant issue. At the bottom it said software update but no mention of what is was for. I stupidly assumed it was something that would enhance the car, clearly not the case. It's only when I took the car out the next day that I noticed something was wrong. The MPG had dropped, wouldn't go in to 7th gear as soon as it normally did and was down on power. They did the same with my previous 350 CDI that was under warranty but was ruined. Got rid of it.

And isn't it truly amazing, or strangely coincidental :rolleyes: that an abnormally huge percentage of 'mistakes' in communications on work orders or prices/quantities on invoices/bills err to the benefit of the supplier? :geek:

Will see how it gets on with MPG but currently not good.

No adblue on my vehicle as it's the BlueEfficiency version.

No I didn't sign any worksheet before the service, and also mentioned to not update the car, I didn't give a reason I just said not to do it, so they wrote it down on the worksheet right in front of me, and this is what's annoyed me!
When I collected the car, I got given the worksheet with what had been done, but no mention of update on there.

They can claim they have a mandate from Mercedes but as Mercedes don't own the car it's pretty meaningless (unless it's on a lease or PCP of course).

My vehicle is out of warranty and I own it, but picked up a service plan for it around 2 years ago, never had any issues the last two times it's been in for service and to not update the damn car!

Hi Im glad I’ve came across your post, I have my car book in on the 25th of this month for this update which I will be cancelling tomorrow
Hope your car sorts it’s self out and returns back to how it was pre update

I'll be asking for a copy and hopefully we can get somewhere in regards to some compo at least.
