thanks for reply television ok i will check battery on monday but it seems to crank the engine over no prob !!

The voltage should be 12.5 volts when standing, one short circuit cell and the car could still crank.

Do the faults go away on a re start

yes they go away untill next morning which makes me think battery.

CAN is data signals that are sent round the car, the car needs to know that it is OK to go to D or R and this signal is not getting through, its a speed signal in this particular case,

Where is this speed signal from? Is it the auto gearbox speed sensor ?

There is a speed signal that is used throughout the car. It starts off from the wheels sensors and this info is given to the other things that need it, the gearbox being one thing. In this case the CAN cannot get a sensible answer to allow the gear shift to be moved, as the speed signal is contaminated, or cannot be read, so to play safe the gear shift locks up as a safety precaution as it does not know if the car is moving or not.

In the case of the brake switch being faulty, what happens here is the speed signal within the BAS and ESP circuits get killed off within that ECU, other parts of the car can still use the speed signal. Please note that when I say killed off, it is not killed permanently, only a temp thing when the switch is faulty
