help needed RTA today 1400

can anyone help me i was in a RTA today on the M5 northbound in stop start traffic when i stopped and the girl in the car behind hit me from behind at around 7mph, i pulled onto the hard shoulder and inspected the visable damage a scuff and a slightly cracked bumper asked her to swap details but she was advised by the person on the other end of her phone i think to drive off which she did saying there was not enough damage or no damage to warrent changing details and that i had her reg number i called the police who took the reg number and logged it and told me to attend my lopcal police station to fill in a form when i got there the police didnt have a form or any one who can help seems the police is a 9-5 job gave me a number to ring who again told me to fill out a form at my local police station i went back to the same office in no mood for the answer no and they took some details gave me a ref number and said someone would be in touch i called my insurance told them the story gave them the other cars details it is insured and said they will investigate and find liability since then i have been to hospital and have neck strain i need to now visit my army doctor at camp on monday this is most irritating as i have almost finished in the forces and this could delay my discharge as ive had my pre release medicals !! she was on her phone before the accident and just before she crashed into me i saw her in the mirror looked like she dropped something in the footwell and was looking for it. i think i did well as i am a bit of a hot head at times but i was polite and stated the facts the car has just been resprayed the bumper wasnt cracked when i left camp, she was on her phone and she hit my car from behind due to driving without due care and attention im infuriated that she just drove off saying there was little damage is she a mechanic ?????? i dont think so where do i stand im thinking of legal procedings

Truly a BITCH !!! Insist that the Police do something it is clearly a case of hit and run since she refused to leave any details, its difficult without a witness but pursue her via her insurance company and claim off them even if she denies it i would !!

My son was watching tv last sunday evening when he heared a crunch and a car alarm going off, by the time he realised it was his alarm and went outside he saw a blue Renault turning the corner he got half the reg plate and a lot of the trim the car left behind, His car a modified BMW didn't look to bad until next morning in the light of day, he called the police at the time of the accident, they arrived next morning and were very helpful but suprised him when they told him they could not prosecute the driver and they could only give my son his details if he admitted to crashing into his car.

Two days later my son was driving along and he saw a car the same as the one that had hit him, he pulled up and the drivers side was totally mashed, with its trim missing, my son had it at his house, my lad took pictures and called the police, they called around to this lads house who admitted to the crash and got his details this made my son a happy bunny.

He took his car to one of the largest repairers in the area who told him not to claim via his insurance and to do a direct claim against the guy that had hit him, they had their own solicitors and boy do they move quick, my son came tootling home in a 08 Disco with a list as long as your arm on what was being replaced on his car, new alloys from the states and just about every fault the cars ever had being sorted.

I think if someone is injured in an accident the police have to act if they are involved, if she hit you in the back she is at fault, toss it over to a good solicitor he will sort it out

You have to remember if the lad in question turns out to be unemployed and unable to pay for the damage then your son will be liable..there is no such thing as a free lunch.. and I think garages and ppl who decide to profit from others misfortune kinda bring themselves to the same level.. and dont start me about solicitors.....

I agree though. Sorry to hear this DrivingGod but your insurance company should sort it out for you. I hope you have legal cover.

police advice

i can assure you that the lady in question has committed a road traffic offence in that she failed to provide name address of the driver and owner of the vehicle and registration mark of the car. if you were injured in any way she is also obliged by law to provide insurance details. both parties are also to report the accident in person to a police officer as soon as practicable and no later than 24 hours. if you say that the driver of the other car was using a mobile phone when the accident happened would insist that the police deal with the driver for the following offences:
failing to provide details following an accident
not being in full control of a motor vehicle
failing to report a rtc within 24 hours

you will need to be insistent with your local police as the drive should be reported by way of summons for the above offences. hope this helps

had more joy today visited the local station again and gave them the doctors report telling them im injured now .they will send a notice basicly asking who was driving and failure to comply within 21 days and they will be prosecuted i have phoned my insurance company to update them of my situation and of the police action and they have also passed me onto the legal department solicitor who will contact me to gain compensation and regain all my legal and medical fees should i incur any I hope they throw the book at this individual and she learns the error of her ways

ohh yeah and if the police try telling you to fill in a self report form they are trying to fob you off as the helpfull officer told me today it is non existant

Just for a some balance... Following a low speed no damage shunt where the guy who hit me drove off, I reported the accident at local police station (I didn't want to risk him reporting and me not..if you get my drift) and gave them the other guy's reg. no. The police followed it up, calling me two weeks later saying the guy hadn't reported the accident and asking whether I wanted to pursue any action or just leave them to call round to his house to give him a "wire brushing", before letting him know that further action was unlikely to be taken. I chose the latter and, though I've no proof, am fairly confident that's what they did.

i think they do follow it up but they are more inclined to do so if there is an injury how would that work then would the police arrest her or give her a warning and how would that affect my insurance claim against her or are the 2 matters seperate if im asked to attend court for her failing to stop and exchange details this has no relevence to my insurance claim or has it. i cant see as there is any argument about whos fault it is i think the police can look at the motorway cameras to see the full incident especially as its so close to the junction i just washed my car and as i thought it wasnt mud on the bumper its where her ****box astra hit me there is a scuff line present the width of the bumper which turns into a hairline crack about 2 inches long at the nearside corner with and the entire bottom part is scuffed would prob polish out but im not going to i spent too much money getting it a1, machine polishes for £300 and merc resprayed most of it due to rust only 3 months ago, it might only be small but i dont own a house and i bought that with money i earned on operations i love that car and il be damned if some little scrote thinks she hasnt got to take responsibility for her actions rant over im actually quite happy today

the lad that crashed into my son is insured and admitted fault

I don't follow what you mean? are you saying because he's going to maximise his claim for the inconviniece of having his car that he's just spent the best part of 8k on improving, new wheels body kit fitted totally resprayed and all the 100s of hours he's put into destroyed by a little pleb in a £250 renault who then didn't have the decency to stop you call that profiting by someone elses misforune. I think your talking rubbish.

I'm just glad my son who is quite a large body builder didn't get hold of him.

I was only making the point that the young offender (regardless of his actions) would and should only be liable for the damage he caused, If that be rubbish then so be it...

Well the "young offender" that gave my son's car a side swipe and then drove off has caused £8700 worth of damage, and thats if the wheels can be repaired, if not a new set will have to be made and shipped from California at a cost of over £800 each and a wait of over 6/7 weeks add on the cost of 7 weeks car hire and it adds up to quite a sum. thats got to be worth 10 hours community service, ooops I forgot he's not being charged with anything.
