Good news it we've found a X5M in Warrington, so can use the loan car to visit it before we return it to Preston.

As we traded in our old car, it leaves us with a bit of a transport issue.
Looks like Mondays commute will be in my hillclimb car, so the wife can use my little 998cc Yaris

Phone call last night it's fixed.

Phone call this morning it's broken again.

Travelling down on Friday to return customer loan car, and can always get home by train if needed.

Think its time to start looking at other brands of car. Pity as all previous Mercs have been great.

Have to say that by now, I'd have told them to keep it or find a replacement.

And this is backed up both in Common and Statute Law regarding contracts. Most suppliers of goods and services have no idea about their responsibilities under the law and will try and bully consumers to accept rubbish.
A chap who has his car in for detailing where mine is bought a new MB (don't know the model) from the local dealer. When it arrived it was apparent that the suspension was sat strangely high. The dealer agreed there was a problem and apparently took the whole suspension apart and rebuilt but it still wasn't right. He rejected the car but the dealer advised him he could take them to court but they wouldn't accept his rejection. Eventually he took a brand new E53, but lost money. The paintwork on the AMG was so bad that it has ended up being rectified...

Well I did a straight swap for my 2007 Ml63 15 months ago, its spent most of its life being fixed for one thing or another at my expense. (Some tbf my choice). Knowing what I know now I would have persevered with letting the dealer sort under the 2 year guarantee, and knowing covered fot a good while. The travelling distance in this instance would be a pita.

The MB 2 year guarantee at this year age is worth thousands of pounds.

If it is Marshalls Preston for yourself a favour and bail out of it asap.
They have messed me about big time and told blatant lies in regards to a section 75 claim and no doubt to the ombudsman currently investigating.
Dont do anything verbally. Document and photograph every detail.
The 'we will look after you' verbal means nothing.
