MOT Fail or Pass

Hi i have Mercedes CLK 320cdi 2006... is this MOT Fail or Pass...
My drivers seat is very hard to lift up to let gran kids out...as it a 2 door is this a saftety...would this pass MOT or not...had it less than a month...

If you bourght from a dealer , get them to fix it under warranty
