Oh and no other alternative offered, ps by a dealership that turned over more than £150 million in 2011. I as yet have not named and shamed them.

By signing you have financial difficulties is there any chance it will get onto your credit record??

Personally I would be in the dealership making a fuss and not leaving untill the DP was sitting in the same office with the sales man and myself.

Having kept an eye on this thread it seems you have been reactive to the Dealership, you need to be proactive and take charge, DO NOT e-Mail back, an E-Mail is the easiest thing to ignore.

Refuse to be complicit in their incompetance and call the DVLA to see where you stand.

This really is outrageous.

Instead of doing the right thing, they look to minimise their loss and bollox to the customer.

If you have a contract with them, hold them to it.

I guess in reality this has left an awful taste in your mouth and, you have no desire to ever consider purchasing a Mercedes again.

Def dont sign it!!! You will be making a false statement to an official body and it could def come back and bite you in the ass. If it was me I would make an ammendment to the document stating wrong car supplied and then sign if you really want to sign it. but I would def get in touch with DVLA and appraise them of the situation and keep the finance company advised as well. I would name and shame the dealer purely on the basis of expecting you to lie for them just to cover their error. I just cant believe they asked you to do this. Surely this is asking you to commit an offence.

Unless this was a 'without prejudice' letter of some description I beleive you should now go to a lawyer and have them draft a letter to them informing them they have adnmitted liability and ask for full compensation then go elsewhere for your new Merc...

I wouldnt admit financial difficulty..who knows where that might end up?? In the eyes of the law you would have a negative credit rating I guess... steer well clear!

If I hadn't of bad the negative experiences at my dealer, I would be finding this so called "solution" hard to believe! However having been called a liar among other things my only conclusion is that MB dealers are on the road to self destruction!
I know my dealer experience is directly influencing my decision to change my car, I have just been put off totally and have no confidence in MB as a manufacturer anymore!
I hope you get something sorted out and do please keep us informed!
As some of us here know, there are some good MB dealers out there, maybe we should all agree to use the good ones thus forcing the ones with "issues" to sort themselves out!

Certainly you should forward that email to someone with a good knowledge of consumer law for their opinion.

You may also wish to consider replying to the email to the effect that you have forwarded it for legal advice. That should wake them up a bit.

Maybe also forward the email to the DVLA for their opinion? And Honest John might have a good laugh about it too.

I believe that the letter that they wish me to sign, is the only route for dvla de-registering the vehicle, the letter suggests that because of my financial position that I was unable to purchase the car, that it has not left the dealership or has been used on a public road.

I think I will be calling the dealership in the morning, request my deposit back, tell them I will not be complicit in any fraudulent statements, and if they do not refund my deposit, and put my plate back on retention within 7days that I will forward all the information at hand to someone who can advise me to my legal position.
