New car order wrong!!!

Please note guys, that the dealer suggested that they would not entertain the idea of replacing the windows as it was not something that they would do, due to cost and risks, however a film could be put on it, however when questioned about a mb warranty on this he really didn't comment.

FYI the film on my windows comes with a lifetime warranty against defects, I have called the fitter back once to correct 2 tiny bubbles which he did without question.

He is the same person that does all my local MB/Audi garages tinting

As I said this unfortunately could have been resolved quite easily by ordering in another car, offering a decent incentive to keep original,

This is correct and would have been the easy path for the dealer to solve a problem and use the incorrect order as stock, however they seem to "not be bothered" so you will have to take a harder stance i.e go to the DP and state your case firmly but nicely.

E-Mail will give a timeline of correspondance BUT as I have said before they are too easy to ignore

The ONLY reason to order a brand new car (as opposed to a demo or 6 month old one) in my book is to be able to get EXACTLY the spec you want with no compromise. So if you want pink with green spots and purple leather, with orange piping, chances are you will have to order new....

SO - to spend £5000 more than you have to to get a brand new car (compared to an ex-demo for example) I think you have the absolute right to have exactly the spec you requested.

I would NOT try to deal with this yourself however, write to them insisting that if they do not lend you a car whilst a new one is on order, of the correct spec then you will place the matter with your solicitor, who's costs you will seek to recover from them as you consider this a very simple breach of contract matter - and then do just that. It's breach of contract, plain and simple, and as long as you have an excellent contract solicitor (rather than some guy on the high street) they will wither and give up - if they have any sense. I don't think any judge on the day will say that spending £30k + on a brand new car, it is reasonable for you to expect to take something that is now what you ordered.

And inducing you to commit fraud (lying to DVLA about your personal circumstances) is possibly a criminal offence and you should keep that one up your sleeve as well.

Resolved ish

Well after plenty of phone calls and complaints to MBCS, CAB's Consumer Service, i had a call from the Manager retracting all previous requests and suggestion, an apology, and now email confirming they have cancelled the order, refunded by deposit and a small amount of comepensation £100!!!. Then i Had the Dp/Director on the phone, apologising for his sales team, and offering to personally deal with any new purchase, and offered me his personal mobile to deal with directly in the future.
I have told them that i accept their apology, but will unlikely be using them for a new purchase.
Job Done, However one car short, back to the drawing board, anyone suggest a genuine sales guy for MB in the Midlands?? or should i ditch the MB idea after years of BMW's this was my first venture into MB world, and i got stung! may be try Audi???

unless things have changed in the past 20+ years, you can't de-register a vehicle. Some dealer tried to the this when they'd bu66ered up numbers of cars ordered & were upset when told they couldn't.
Is the dealer the registered keeper in these circumstances?

Well it's good you have a resolution, I would shop around, if you have a stale taste about MB then the new Audi A6 is lovely with the 2.0 TDi in S-Line spec.

There must be another dealer near you or just call around some and get a deal, a bit of travel is no real problem for the right car at the right price

Well it was my first virgin effort at using a forum for popular opinion, and i can only thank you lot for some support, you all deserve a pat on the back for being interested in my situation, i'm sure ill pop back now and again now that i have a taste for it, thanks once again.. Great Forum!!!!!

For what's its worth I always found the dealership in Worcester (in Blackpole) pretty good ... Not pushy but informative and helpful...

Been to a few and they were about the easiest to deal with...

Yeah I bought my E350 from them, very down to earth and accommodating.
Mind you, never really had an issue either, I guess that is when you really find out?

Sorry, can't remember the details now, other than dealer had tried to deregister cars and DVLA told them they couldn't, but it could have been.
