Problem with class of vehicle and a speeding fine

Can anyone help with this please?
I have a Vito122 CDI DUALINER A
When I bought the vehicle I was told it had the same speed restriction as a car. This was because it has 5 seats and side windows. I bought it so that I could take all of my grandchildren out together.

I recently received a speeding fine for doing 60 miles an hour on a road with a 60 mile an hour speed limit. It states on the notice that my vehicle has a 50 mile per hour speed limit?

Have any of you Vito owners come acros this same problem?

If it’s a car derived van then it’s van speed limits. So I would say you’ve been done. Whoever told you that it’s down to windows etc doesn’t know the law. A car derived van however is the opposite.

Sadly it looks like you were misinformed.
The GVW for the Vito Dualiner is 3050kg which puts it above the dual purpose vehicle limit of 2040kg.
It therefore becomes a van and is restricted in the same way unless it was registered as an MPV.

Yes if it is a van then 50 mph I know as i have recently done a speed awareness course, the course was very much worthwhile as now I know I can only do 50 max in a 60 in mine ;)

you wont be alone there andy , I'd wager many van owners have been caught out in the same manner !? which always makes me wonder how these delivery drivers in sodding great sprinter vans and such like manage to get anything done on time ?

But the article isn't too clear. What about 40 and 50 limit single carriageways and if a dual carriageway has a 40 limit (as mentioned) is the van limit then 30??

No its the same as cars except as listed.

I’m sure the police just let them slide. Ever seen one get pulled over? I never have. And if it isn’t an Audi or BMW steaming up one’s rear end nowadays, it’s a white van subcontract multidrop driver trying to break the speed of sound.

I thought it was 10mph under a car speed limit, but appear I was incorrect. It is only on single and dual carriageways, whereas motorways are the same. Wonder whether that means restricted/unrestricted dual carriageways.

Anyway, I think you can consider yourself very unlucky

As said it is dependant on how the vehicle was registered, the V5 will show the class as N1 (with speed restrictions), or M1 (classed as a car with no restrictions).
I am guessing at new there would have been a choice for some 'vans' to be registered either way. Some opted for N1 as the tax would be a saving £280 p.a.
The DVLA won't re register, I've tried. Unless you can demonstrate that it was originally registered incorrectly.

As I don't feel the need for the additional speed, I set cruise at 58 mph in this (M1 Viano) as I did i the N1 (previous Vito), I would prefer N1 classification.
