you've fallen foul of the soft ware 'upgrade'

It's been widely commented here of the situation you're now in. The cure will be replacement NOx sensors at some considerable cost.

I think the most sensible approach on this is to get the dealership to sign a disclaimer before the car goes in for the upgrade (a fellow member did this and I don’t think they would sign but as it’s not mandatory update no problem don’t have it done) that if said upgrade turns on the EML light said dealership will be held responsible.

Re the OP’s situation I’d certainly have a meaningful conversation with the dealer and refer them to online evidence of other owners suffering the same fate. The dealer knows what the problem is without a STAR diagnosis the update will have put the Nox sensors out of calibration.

Out of curiosity, if it’s software, why can’t it be put back to what it was before the update, if it’s not mandatory?

Surely a dealer will just spout bs but, the fact if not mandatory, they did an upgrade and caused a fault, now they want to charge further for known issues. It’s software, just like any other, just ‘roll it back’.

Word has it that it’s not possible to reverse the upgrade - that’s possibly their default response but as someone once said ‘they would say wouldn’t they’

That’s a first who takes a car on a 70 miles test run - keep complaining until they accept responsibility and if they don’t escalate your complaint to the dealer principle and ultimately to MBUK - make sure you do it in that order

this is utter rubbish

you don't want to return the car to the faulty state it was when you dropped the car off

but you do want mercedes to make the car legal!!! by fitting as many engine management components that land you with a car that is legal to use on public roads - the ones it was sold with brand new was NEVER this

it was their legal obligation to meet the standards but they deliberately didn't bother - they got found out!!! - and now the law is 100% on your side they have nowhere to hide - and must ensure it now hits those original emission standards - it is NOT your responsibility to pay a penny towards this happening

you have rights - the law has told them to sort it out - go back and fight
