rust warranty

mercedes e-class e280 advangarde 96 preg has been to mercedes dealer ship requires 4new doors 2front wings and bootlid all because of corrosion estimated £4000 car has full mercedes service history from new yet none have ever adviseed this could have been covered by the 8year warranty as my car is now 12weeks outwith they are not interested is there any other e-class owner with similar corrosion pattern.

Err, one or two..

MB are indeed covering cars upto eight years old. If you fight hard you might get it covered.

I would personally think you should have a claim against them if you say it needs 4 doors and a boot lid these things never all went within 12 weeks, they should have spotted it starting to rust when it was getting serviced, they are supposed to check for corrosion to keep up your corrosion warranty negligence in their part I would keep fighting and the best of luck

Agreed, it should be the dealer's problem. They have had the car and should have advised you this needed doing long before. They should fight your corner and get Merc to pay, or pay themselves.
To be honest my dealer didn't say anything either and I had to go to them. At the last service I made a point of having them do a formal corrosion check - logged on the paperwork.

I got legal advice on this type of thing because they tried that stunt with me on a couple of items.

Go back to the dealer and tell them you are going to sue them if they don't repair it. It will hold up where there is clear evidence that a competent and skilled tradesman should have observed the fault and advised you of the repairs needed in a case where the fault was clearly in existence at the times of the services at the MB dealers. They have certain responsibilities and duties to you as theor customer to carry out the services comkpetently and to advise you of any defects. Because the issue of warranty arises they are somewhat seen to be judges in their own court and will have a harder fight on their hands to escape liability. You have an even stronger case if you have a good MBSH. They won't want to argue it in court anyway because the only thing that can happen is that they would be judged incompetent. It may hinge on when car was last with MB but there is so much stuff out there now it should be easy to prove its a common problem well before the age of 8 years. I know, mine are gone in 4 years.

This would be a difficult case in court because the problem hasn't rendered the car dangerous or unroadworthy, simply a mess.

The real complication is that this isn't covered under a corrosion warrantee as A; the warranty wasn't in force at the time the vehicle was purchased new and B; the newer corrosion warranties only cover "perforration from the inside to the outside.

This type of corrosion although emanating from within the outside of the car, isn't strictly perforration through a panel.

MB are getting round this by performing repairs on a "goodwill" basis and not actually claiming against a "warrantee".

If MB definately decline to fix the corrosion then rather than getting drawn into a costly legal battle, it might be better to go public to a body such as Watchdog.

Please don't think I like this any more than you do, but realities and facts cannot be ignored.

Warranty

Thats interesting my c250 TD purchased private second hand has some rust elements. The car reg April 98 R plate has some rust to the rear passenger door where probably knocked. Also blemishes to side door panels. Probably caused by road chippings.
Wishful thinking any chance this is covered under the 8 year plan??
