I asked because the legal position is more straightforward if you owned the car from new.

You could try another appeal to MB perhaps adding some info about the US and Malcolms's excellent explanation that the system in inherently flawed, and noting that it's no longer fitted. You didn't buy the car expecting to be part of the field test program. May also be worth mentioning that you are considering going to the press. However, once you go public MB are so arrogant they may well refuse to pay for fear of opening up the floodgates.

I do wonder what level these complaints get to in car manufacturers though - you need to get past the customer service "grunts" and up to a higher level. Didn't somebody here have contact with, if not the MD himself, at least the office of the MD of MB UK?


If you bought the car from an MB dealer and they're still in business then you could ask them to fix it under the Sale of Goods act. They may well laugh, but, you have to ask if a reasonable person would expect a "quality" car like a Mercedes Benz to last 5 years without significant faults. If the refuse, then get the job done and send them the bill. If they don't pay then issue a small claims court claim using their online service - you have to sue the people who you bought the car off. It costs little and the results are a bit random but I would hope you have a good chance of success.

I'm sure lawyers will chip in but, in these cases, its always a good idea to annotate the invoice with something like "paid under protest to gain access to the vehicle". Therefore documenting your intent to take it further.

Going legal will trigger MB's legal team and that's the end of any kind of quick outcome....

Best to present your case to the MBUK boss with all the supporting evidence and request his "assistance" to get common sense to prevail and provide a suitable outcome.

Add a sentence showing that while you hope that will work, you will not let it go if it doesn't.

Alfie, there are many precedents for goodwill on this part - I opened a discussion on "the other forum" as well where 52 reg cars have been repaired free - you should collate the info, present it again to MBUK and make it clear you are prepared for a fight.

This is actually the third time I have asked for a contribution on this one fault, all have been refused:(, the first time they refused because the dealer had told them my car was a 1999!!!:shock:, and they said ,if the car was under 5yrs old they would have paid for the repair:D, I then said it is under 5 yrs old and they said ohh in that case we will reopen the case which they did, then when no reply came I rang them and they said ohh sorry it was refused again:mad:, when I asked why, the chap said he did,nt know but it had been refused, I then sent all the details back to MB and reopened another case, then came the reply I posted on here, ive got to be honest I dont think Mercedes are interested in Customer satisfaction or the safety of their vehicles.:mad:

E 270 Cdi W211 SBC replacement

Hi Alfie, I have just today had a free 'Health check' of my 2003 E270Cdi which I bought from Mercedes Direct 2.5 years ago 75000 on clock. I was told that the SBC needed replacing as it had reached the threshold and had not had the required updates. This is being replaced free of charge by Worcester Mercedes on FRiday. Strangely after I e mailled them stating that I am going to the press and post the information, on here and the internet in response to their refusal to any contribution, a lady from Mercedes Head Office rang me and asked if I was going to go to the media and the press with my complaint:rolleyes:, I said yes I am as I am feeling very agrieved that my brake failure was just dismissed, she said so you are telling me that you will inform all owners of Mercedes E Class cars that their vehicles may be unsafe!!!, and I said yes I will,:) she said would I hold out doing anything and she would ring Carlisle and see what she can do, I said I will await her response on the situation, I also asked that a parts only contribution would suffice, so watch this space!!!.she also said oh and by the way my decision is final.

The difference is response is bonkers - his gets changed without him even asking and you get (so far) completley stone-walled.

You just can't help thinking that someone, somewhere in MB's Universe would be horrified by your treatment. However getting to such a person can prove impossible (except for the press, of course).

I probably have less respect for those companies who instantly capitulate when approached by the press than I do for those who stick to their guns. If they're going to give in, why not just do the right thing in the first place?

Unfortunately after speaking the Mercedes again regarding the SBC and asking for a PARTS contribution here is their reply to me and my reply to them:.

After taking the whole sorry episode into account and as I mentioned to you previously I have now decided to go to press with the full story, mainly to warn proposed customers of the safety concerning Mercedes Benz SBC systems, I have been told that Mercedes have dropped this type of braking system because of numerous warranty claims and also court actions in Britain and America. I have posted some of the story here,and on another long running post on this Website you may notice there are quite a few people willing to assist me in any further action I may take, I not only feel you have been unfair in the manner of which I have been treated but also, I feel you have total disregard for your Customers safety. I am now in the process of compiling the full story to send to What car and Top Gear and Watchdog programmes.

I have just had another approved fully... This car is and 04 reg car with full history.. none of it at MB.

I dont understand this case at all...

We cannot work out the logic either Jay with some of their findings,,its the same on other things as well,,OK for one but not for another :confused:

This is bonkers - there *must* be some logic to the way MB handle claims, it surely can't be completely random.

How does the dealer access the goodwill system - can they ask why other claims are being met yet the OP's isn't?
