Thing is, this isnt a dealer issue, but a manufacturer issue. The dealers hands are tied so really he is pointing the gun at the wrong people.

I admire his gall tho.

The dealer is authorised by MB AG/UK to sell, repair and supply spare parts under licence. Yes they represent MB but as regards warranty the are subject to the terms and conditions of the manufacturer. They are literally the mouthpiece/messenger for MB. It is MB who set the T&Cs of any warranty/goodwill.

MB South West do not manufacture anything for MB directly therefore they have no case to answer here which is why I say the gun is being pointed at wrong organisation.

No can't accept that, the public can only deal with the official representative, it is clearly unrealistic for the customer to work his way through the command structure.
I flippantly mentioned Mercedes World as it may get a better reaction but your average Joe clearly is not placed to do such a thing.
The decisions are made by MB but the dealer takes on a position of an access point when he/she takes on the dealership as I said before you don't just take the money.
British Law generally expects the retailer to take the hit.

If the matter was pursued through the Courts in this case (probably Mobilo claim) it would probably be against MB UK, the Courts would accept them as respondents despite the fact that the decisions eminate from Daimler Benz.

It is uncomfortable for the dealership but they could always get a divorce citing unreasonable behaviour.

It's a pre-facelift 220 so isn't it at best a decade old? I probably wouldn't look that good if I was left out in the rain for a decade!

... oh yes, an MB dealer. The same dealers that promoted the 30 year body corrosion warranty. In fact, they probably sold cars on that basis. Especially the high end models, like the w220.

Remind us all, please, where the legal charge on warranty rests to the customer. The supplier or the manufacturer ?

You buy a TV from Comet and it goes faulty. Do you get Comet to fix it or the company that made it ?

It shouldn't be.

Manufacturer makes goods.

Goods are sold through retailer via distribution.

Retailer sells goods to customer with manufacturer warranty.

Customer buys in good faith.

Problem develops and customer claims on retailer who claims on distributor who claims on manufacturer to sort out the customer problem.

Although MB seem to make more red tape than vehicles in order to ensure that the customer warranty is not worth the paper it is written upon.

They even break block exemption rulings.
