It only partially turns the system off, never completely

no there is no led on it but when you turn on the lights on the car it lights up like the rest of the buttons . there was some ice on the drive earlier and i got the wheels to spin a bit before the traction killed the spin and noticed no warning light started flashing so im starting to tink its more than just the switch maybe ill just take it to a dealer so they cant test the esp system

OK up to you, but I think that you will find it to be normal

With ESP on, even without flooring the pedal, I've managed to spin the rear wheels when setting off on wet roads a few times. It made me wonder just how effective traction control is on the CL especially as the handbook barely mentions traction but rather focuses on stability. I've had other cars where the traction control intervenes more quickly and to better effect.

With ESP turned off, the large yellow ESP warning lamp in the instrument cluster is permanently lit.

ESP is to do with stability and not traction, it corrects the car if it slews or breaks away
