As a guess he may have had the car held as stock for months and only registered it in December when deciding to sell it privately, most dealers do not register their ownership... If the car had been sitting that long and only started and taken for short test drives then the DPF may very well clog up but I'm no mechanical expert....

Enough trading standards hassle he may just settle with you, otherwise it may be a good time to seek some legal assistance from a Solicitor...

When we look back on the conversation we had with him regarding why he was selling the car, we was very stupid as he said he had the car just for 8mths for just short journeys to and from work, he said he hadn't had it serviced (2017) because of the short journeys (Yes I know we was stupid to believe him but we never knew anything about the DPF before ) We paid a deposit and came back the next day with the cash only to see a car worth a lot of money on his drive!! We was well and truly done!!! I can see you all laughing now!! Still a lovely car though!! And he will not get away with it

Don't feel embarrassed at all Leo - these guys have the knack of coming across as genuine people... when they are genuine salesmen they sell themselves before any product so as you come to believe in them, they've got a happy customer in the making.

But when they're "bent" like it seems this guy is, there's not a great deal to differentiate between them - they still make you believe they're genuine/honest people etc so they can sell you something. I hope you 1) sort the car out - 'cause you'll still end up happy with it - that's the built in magic of a Merc and 2) get some result from your efforts to have money refunded or get him turned over.

The really sad thing is that there are actually a lot of genuine motor sales people who want to give a fair deal and want to grow with their business with repeat custom from people like us. But unfortunately it's just like the internet poison - it's a dodgy world out there and it's very hard to decide who is genuine and who is not.

Thanks! I'm happy with the car, had the DPF changed £900 but just need to get the fan checked out now with it not kicking in when it was regenerating the other day.

Did the car overheat when regenerating and is it overheating whilst being driven?

During the regen process the car burns extra fuel to heat up the gasses and the engine has to be at full temperature, it may not be the best environment to check the fan operation...

Don’t worry about the fan not coming on during regeneration mine doesn’t every time especially in this weather.

You will get used to having a DPF on the car but unfortunately there is very little in the user manual to explain about the regeneration process and what it entails, no doubt the manufacturer’s discussed what advice to give and decided to give very little which I think was a mistake, but from their view it is an automatic process

Absolutely no one laughing. I doubt there a single one of us hasn't fallen foul of a rogue salesman at some point be it cars, or other things.

If you end up getting a judgment, elevate it (it costs but you should get it back) to the High Court collection. They pass it on to "Sheriffs" who can't be ignored or mucked about - they turn up and either get the money or seize property to pay it off. The tv program Can't Pay, We'll Take it Away" is one heck of an eye-opener showing what they can (and do) do!

Best of luck - it's horrible getting screwed.

If you get a CCJ and the High Court don't get it back for you then you can ask for a charge to be applied to his property and then just sit it out. He then has no control that if he sells or remortgages his house you get given the money back out of the proceeds with a statutory 8% interest PA!

You can also apply to the court for him to declare his financial position. The judge will order him to attend and if he doesn't he gets lifted. Once you have his financial declaration you then know where to look to recover the money, with the charging order i mentioned above being the last resort.

Sorry to here of your situation Leo and I hope you get it sorted otherwise it will sour the ownership of your car.

Anyone know anything about "ADR" Alternative dispute resolution?? Consumer Rights said to me that if we don't hear anything from the fella that we can go through ADR

Well almost a year since we bought this car..I didn't get anywhere with so called private seller who sold it to us! To be honest with you we gave up sending letters to him this now is something we regret as we have had nothing but problems. Couple of thousand we have paid in repairs! Now we "think" the turbo on way out.

Moral of the story is do your homework and not to purchase privately an expensive car with fragile expensive hardware .

These engines have enough fixable issues regardless .

Consumer law is very much on our side when purchasing retail .

#1 rule with dpf is to identify the cause of it's death or it's the dpf death merry-go-round .


Buy a new one , clean it or simply get rid.

I doubt it wanted a DPF anyway, probably a sensor and software upgrade. I am seeing so much mis-diagnosis by other garages now on DPF related faults because they don't have the knowledge, Xentry STAR diagnosis and access to WIS and TIPs or carry out basic test procedures.

Goes without saying really. As politicians see more political benefit from showing green credentials they will update the laws regarding testing. Just because they updated last May doesn't mean they won't do it again this May. MOT guidelines change all the time.
