Refusal of a refund for £3,100

Okay!.. seeing as you asked!…deep breath.... The credit card company gave their finial decision in November and rejected my claim of £3,100, that was their final decision.

After I accepted that the seller was going to keep the car and not refund me I had help from citizens advice on issuing him with the first warning letter for the refund, he ignored this and continued to insist that I would have to take court action in Norfolk.

He thought he was home and dry bearing in mind he knew of the CCC’s finale decision and the sheer physical distance from me here in Plymouth and him in Norfolk and all the costs and expenses that would be involved in me attending and the inconvenience, stress and worry.

When the ccc investigation was over I went to the Financial Ombudsman who investigated further and over turned the ccc decision and found in my favour.

I was awarded the full amount of £3,100 refund and an 8% interest on that figure for the total length of time it was owed to me starting from the day the payment was made on the car 13th August 2022.

Now the seller has had this amount of money taken from him, he now has a car that is 6 months older, that has serious roadworthy issues, that all the official authorities are aware of and a black mark against him with all concerned.

The refund was paid into my bank account last week in full with interest. :)

I would have loved to see the look on the sellers face when he knew he had lost and forced to hand over the money. :D
Very poor of the credit card company not helping you, especially considering their decision was proved to be wrong!.
On a point of principle I would be cancelling that card and going with a different one.

Great summary and makes sense why it dragged out, all due to the original ccc decision. I don’t get on what grounds though as you presented sufficient evidence. I know you said he lied but there is a difference between lies and evidence.

Yes, very disappointing regarding the CCC final decision and a big surprise to me my experience with them has been completely the opposite after all considering the exorbitant levels of interest these companies charge you expect them to be very good on customer care, I suppose the CCC in question values the seller more than the buyer they’ll learn

Do the CC have a policy of reject claims generally?
How many give up at that point? As they have superior power I would suggest most.
Those that pursue and cause an eventual pay out is likely cheaper than paying out all valid claims.

You might say that is good business, I say it is corruption. As they are selling their product under a false pretence I suggest it to be fraud.

I had a claim against a double glazing company about 5 years ago, I paid a £1500 deposit for work that still hadn’t been started 6 months later, the CCC company were quite thorough and listened to both parties before making a judgement in my favour.
I would expect the CCC company to get a wrap on the knuckles from the Ombudsman in the OPs case they should have sorted it it was clear cut case the car had been returned to the dealer.

Pretty much everything is corrupt but most of the world is blind to it.

Sadly this is a tactic that many use, make it hard to complain, not worth the hassle, through under handed tactics make themselves seem untouchable without remorse, it’s visible in all sectors.

Duncan Lewis solicitors are next on my hit list who have been very unprofessional, taking advantage of legal aid, playing dirty etc, they know it but think they are untouchable. Sadly for them, I have remained silent, allowing them to dig their own grave, gathered enough irrefutable evidence, despite cost or largely known outcome of the corrupt legal system, at the very least I will be hitting them like a wrecking ball in the side. I will pay to cause them the same grief they have caused me, at the least have them investigated for their corrupt acts. Let’s light a match and see what happens!

Great result and I'm so glad you got the result you deserved. Maybe now it's the time to report this to rogue traders or the like.

Great result and I'm so glad you got the result you deserved. Maybe now it's the time to report this to rogue traders or the like.
Tell me who they are and where to find them and I will do it, I don't owe the seller a thing and it might stop him from doing this to others who are not quite so resilient.

Not the service as purported,
it's all business.

Imo there is going to be more creating their own justice, as the justice system protects the state, the elite, and the wealthy. The rest of us plebs are just an annoyance.

You obviously haven't researched the guy. This will be of little worry to him. Not saying it's right but he's just one of those guys who would brush anything off and keep on doing. Personally I'd just forget it now as life is too short, you took a chance and engaged with the lowest form of trader so were lucky to escape mostly unscathed with your money back..

Whilst it’s true a leopard won’t change its spots and continue on his way, it’s free to report them to rogue traders etc and it will play some part in preventing some other poor soul going through the same.

I agree with your sentiment but that would be to obvious, better to have a walk round his lot and do it that way. ;)
