A160 Auto Gear Box 65,000 needs replacing

Our car has been at lancasters lakeside since last posting and they gave us a 4 door smart car loan vehicle in the end. However last week we were told they were waiting for a part from germany a modified hydrolic control unit, which has been modified to solve gear box problems, they fitted that and a floor shift unit. Cost was £1400 with labour, mercedes agreed to pay four hundred towards the total, making it a thousand, our feelings are that mercedes should pay for the cost of the modified unit and labour to fit it and we should pay for the rest of the parts. We asked lancasters to put that to Mercedes, we got a phone call back from lancasters five minutes later in response we have basically been told pay up or they will removve the part and charge the labour.
So we feel we cannot go any further this way, we are going to pick the car up tomorrow and take our case through the court because we believe our problems from new with the car are down to this part and as mercedes have modified it because of known problems it should be down to them. Sue

I reckon you should get on OK in court - although is it clear who you should sue?

I think lancasters, because that is where the car was bought and it is because they could not find the problem it has gone this far.
