Thank you fella, insurance solicitors are on, they are the best kind of solicitors because I am not paying them LOL
The good thing is that that type of solicitors (even when they are briefed by your insurers) try to refuse or severely limit their work on any case where they think they have little or no chance of success and of course with councils they get their costs paid by them fairly easily too. Regardless, I sincerely hope everything goes your way - so all the best!

Sorry to read this, and you were very fortunate the car went into the ditch and not the oncoming traffic. Still a nasty experience.
Hope you don't end up out of pocket over something you had no control over.
Damn councils are too slow repairing these deep potholes.

Thank you Roger we all deserve more from Highways depts in the UK specially considering road fund costs (yours at £400 plus I guess) but our council thinks its cheaper to spend £1.2 mil a year on alloys than tarmac so I am considering a John Deer for my next vehicle regards Steve

Glad you’re ok. You’re not far from me and I know exactly what you mean regarding potholes. I hit a pothole last January in the Mercedes, bent an alloy and car never felt the same.
My claim was rejected however, because I reported it ASAP, others got theirs paid out who hit it after.

Lincolnshire roads are terrible, but we are very similar to other counties (still not saying
they’re good!) I drive all over the UK and there’s been some places that were worse then Russia, and believe me I’ve driven there!

Genuine question, should the council ask for more money to do a proper job over the next few years?

Whole council system seems an old system that needs overhauling

Oh yeah, the police made them come out immediately and fix it because they had attended a damaged car from the same hole two weeks before and nothing had been done, my insurance comp is straining at the leash to go to town on them kiwi
Great evidence for your claim against the council.

Our council spent £1.4 mil on pot hole damage cases last year and that is only the 9% of claims that were successful, the rest failed
I reported a similar hole on an estate road to Staffordshire Council last week, I said it was dangerous. They fixed it in 2 days.

The system is broken no doubt but its more about priorities than how much the council get funded, the roads around Grantham are appalling and yet £90,000 has just been spent on a statue of Thatcher and a large budget put to one side to keep it in good repair because they know it will be very unpopular and damaged on a regular basis

And that is how it should be Sonic, Rutland is a county that meets ours and the roads are impeccable there

I was just thinking another good use of the dash cam! Lets hope that eliminates any wriggling from the council.

Think policy is deny everything unless as yr case impossible, as long as total payouts =less than repairs its a good deal for councils. AND the legal profession, whilst a crap deal for the injured motorist,or worse, then another good earner for legals...

If you notice it is a LHD CLS so the tractor drove right over the driver...
I was thinking that and looks like the little long haired one in the dress near the tractor was probably the driver, the other three from each of the farm vehicles, Bless her. If that was my CLS the bonnet would have pride of place on my workshop wall forever more.

It would make a great conversation piece...

I keep getting Jimmy Hendrix - Crosstown traffic in my head every time I look at the picture...

I'm not the only soul who's accused of hit and run,
Tire tracks all across your back, uh-huh, I can see you had your fun.
But a darling, can't you see my signals turn from green to red
And with you I can see a traffic jam straight up ahead.
You're just like Crosstown traffic, so hard to get through to you.
Crosstown traffic, I…

Looking back at that picture, it was the tractor that reversed back up over the CLS, would love to have seen the insurance form when it was written out :D
