320 CDI Acceleration and Kick Down Issues

Bought this320 CDI as a CPO about 400 miles ago. Day of delivery, drove away and car was very sluggish, it wanted to shift through gears quickly w/ no acceleration. Bought it back to dealer, shut car off and waited 10 minutes for tech. Tech came out, started car, and no issues. Car flew like it should. Yesterday, drove on a 100 mile trip, and after stopping in a toll plaza, went to accelerate and same thing. No acceleration. Today, drove 100 mile trip again, had to do a "kick down" to pass a slow car, and the problem resurfaced. Pulled off to side of road, shut engine down, waited 30 seconds, restarted, and car was flying again. Anyone have a similiar issue and how was it resolved. It's going in for service and dio this week. Could use some feedback for dealer. This does not appear to be an engine (itself) or tranny issue, but perhaps a chip, sensor, or along those lines.

What year?

If it is a 211 I suspect that it is a sticking turbo.

failing MAF?
Sounds like it's dropping into safe mode (hence restart cures it for a time) so hopefully there will be fault codes stored. I've only experienced this once but the symptoms were similar - kick down and instead of acceleration, it just chugs.
I've not heard of a sticking turbo on these models but to be fair, I'm an amateur and BlackC55 is an expert, so I wouldn't argue.

Sounds like the symptoms my W210 320 CDI had when the MAF was on the way out.

First start of the day it was slow, and wouldn't kick down, and then once it had been running for about 20 mins. it was fine.

This went on for a couple of months before the sensor finally went altogether.

ive had the same on my 210 for the maf sensor however dealer charged 300.00 for new sensor

and is a very easy fit on w210
