big problems with new vito 111 cdi van

i am looking for advice on where to go next as own a 04 plate vito 111 cdi with 19k on the clock with fsh all stamped i have owned now for 10 months and since then it has had rear door hinges painted now rusting again a full gear box strip down(could not select gear when cold), a new sam unit , front suspension probems , a new track rod end , two new rear shockers , propshaft bearings, a new front headlamp ,a new rear door catch,four new steel wheels (rust)also comes complete with a alarming amount of rust starting to creep through a lot of the panel seems or joins this is fairly small but it is in many areas and underneath that is no better either , i have wrote a lot of letters to the main mercedes place in milton keens but they say they are investigating the situation i also had a phone call from a main man in dundee to say the van was going to be replaced for a like for like but nothing in writing it has being now four months im still waiting and ringing but they insist they are still looking , i now need to know what i can do as iam sick of waiting any longer please can any body give me some advice

it was purchased from john.r.wier a mercedes dealer in aberdeen and told me to contact there head office basiclly no one gives a **** they have got there money looks like its a trip to the soliciter

Jeez... you must be one patient guy,

This has been going on for ages, I can't believe you haven't had the new van yet. Have you got this offer confirmed in writing yet because if you haven't you should insist on it before they change their minds or the person that made the offer leaves (or gets fired!!!)

I am in correspondence with Mercedes customer care in the Netherlands regarding all the faults I have had on my van but it is a slow process and in the very early stages so please keep us posted on how you get on so I can compare it to my experience.

Probably.

Even if you only have an initial consultation you will most likely come away with a clear idea of where you stand legally. I would expect that given the knowledge that you are involving some legal experts in the equation will be enough to bring a faster resolution to your case.

My advice is to go see solicitor too. The thing is, once they go outside the warranty, once you can prove a vehicle is not fit for purpose, which is very much the case here, you can introduce lots of compensation issues, loss of work time, inconvenience etc. Their best way [and yours too] is to replace the vehicle to avoid that issue. Given that they rang you I think the wisest move is to go to your solicitor and have hime write to them confirming their agreement to replace it. Strengthens your position verry much.

Posts: 7 my 04 plate vito is also poor underneath its taken me 5 months of batterling trying to get rid of the piece of crap that john.r.wier aberdeen mercedes dealer sold me,i have gone through mb at miton keynes they have said they will replace the vito for a new one at my expence bringing me a full cost of £19000.00 for a vito if i trade it in,so basically all i am doing is trading in a van i have had for 9 months and getting a new one. i also had a test drive in a brand new one with 6 miles on the clock and i could not belive how better it was to drive in all aspects it was like driving a different vehicle . so it looks like i am stuck with with a 04 van with 20k on the clock and in 5 years will require body filler .MERCEDES ARE A PILE OF ****. i think my options will be to try and sell the crap and of to vw for a t28 2.5 engine i bet you will not get any rust on there vans

i spoke to a soliceter and basically with out spending thousands i am stuck with it either way i keep it or i spend £6 thousand on exchanging it and as if i am going to do that i have had a gut full of mercedes to last me a life time i am of to VW T30 TRANSPORTER 130 BHP ,if i can sell the ****** thing

update on rusty04 plate vito

:grin: at long last mb have exchanged my old 04 plate vito for a brand new one at long last basically they bought back my old van plus giving me back what i paid for it and i had to pay the remainder for the new on all in all £4000 on wich after a good think about it it was not a bad price free motoring for a year . when i picked up my new vito it had 4miles on it but driving it is unbelievable it is like driving a different van it is loads quieter loads smoother it pulls better the engine is totally different when starting even the ****** doors shut properly but the best thing it is doing 70 more miles to the tank than my old one ****** fantastic and driving on motorways there is no holding it back it ****** romps on . i asked why is there so many diffrences and aparantly in 05 they changed so many things to the vito at long last . i feel sorry for the people how have the 04 plate vito for god sake dont have a ride in a new one it will break your heart:grin: :grin: :grin: :D :p

Just got to wait and see what they make of my complaint about the quality of my van now. It is painfully slow and each phone call gets the same response ("we are looking into it"?). Going back into the dealer this week for more work on the clutch as it still isn't right (in fact, it is definitely wrong!) The warranty is now a month gone but bless them they are still buggering about trying to sort it. I wouldn't mind putting some cash into a deal to swap to a new shape sprinter, but not a lot as I am a bit skint after buying the current one. A merc breakdown mechanic told me that strangely for a newly launched vehicle they haven't had any problems yet. Perhaps this is a good sign for Mercedes at long last?
