CL500 Got damaged 6 weeks on!!!

As many of you know my CL500 got damaged when the boonet open at speed whist the car was with a local garage having the MOT done.

Anyway some weeks ago the car came back to Mercedes in cambridge but the bodyshop chap wasnt happy so it went back in.

I was due to collect the CL on saturday so the wife and I drove over to inspect and collect. There where many things that I wasnt happy with so the car was left with them to got back and be done properly.

One problem, the front bumper has been damaged quiet badly, when the car went in I wanted a price to paint the bumper but the response was the bumper needed to be replaced at a cost painted of £1100.

So far Im not happy as the car has been away for 6 weeks and this is the second time its returned to the paint shop, now the bumpers damaged, where do I stand, will they expect me to pay towards a new bumper or will they fix the damage, Ive already spent £500 ++ on a new front wing because they had to blend the paint but the front wing was rotten and couldnt be repaired and all I wanted was to MOT and use the CL through the summer and its turning into a finacial nightmare.

Any advice please as Im about to get a solicitor involved.

Damage Repair

They are responsible for any damage that they do - full stop! Repair work should be to a standard that is acceptable to you. Having said that, any reair carried out should not invalidate your Mobilo Life Warranty, if at all possible. Reading your post, I'm not sure if you wanted them to repair an existing problem on the bumper or if it is damage sustained whilst the car was in their care. A reasonable view is that they should fix any damage that they do.

The rotten wing is a different problem; you might have to pay a proportion, say the materials. If respraying was necessary as a result of their carelessness, then they should at least carry that cost.

Don't give in to them easily!!

I requested a price for a respray off the front bumper as there where several stone chips, the bumper was acceptable but since its return it is badly damaged.
I wont be spending anymore towards the costs to repair the car and if the work to repait the car isnt good enough it will keep going back.

Bumper / Damage Repair

It is clear to me that they should pay for the replacement bumper as they caused the damage or the damage was done whilst the car was in their care.

Pity that you've already paid for the wing as there might have been some room for negotiation on the basis that they've mucked you around and been without your car for some time.

I noticed that you were thinking about going legal.....personally, I would use that as a last resort, as that approach can sometimes be counterproductive. Having said that, I know how you feel!

For interest, some time ago, when my car was in at the local MB dealership for service, they managed to damage one of my alloys - not kerbed or anything like that - it had been laid down on the floor polished side down and damaged by gravel. To their credit, they replaced the wheel without any question.

Sorry this has happened to you, but I'm sure that if you keep at them, it will eventually be to your satisfaction.

Sounds like you are having a nightmare with this car, A solicitor is gonna cost you time and money and more hassle.. Personally I would be thinking of going down the BBC Watchdog route or that other guy ' Dont get done get DOM' garages dont like bad publicity..worth a try..

I still owe £265 + vat for fitting the wing and primer, also repainting the wing mirrors, the new wing was paid for sometime ago.
I will hold off the legal route for now and give them the chance to sort it, Im not one for going nuts about things like this but like to be clear with whoever that things are not right.

As you probably have a catalogue of dates, times and costs, the Small Claims Court is another possibility. A great many suppliers invited there choose not to defend the case and pay up. The others lose on the merits of the case, so your chance of success could be high.
Citizens' Advice Bureau will give detailed on the process advice free of charge and I would bet that is also available online.
Best done when you feel that further progress is impossible, otherwise the court could ask the parties to try harder.

Collected the CL tonight and I am very pleased with the repairs done, the bumper was also polished out so alls well again.
