CLK350 convertible: boot divider issues

Hi Folks,

I have a 2006 350CLK convertible - opening the roof is now an issue as the boot divider 'springs' (according to the local dealer) have gone 'slack'. Obviously one would expect this to be a warranty item on a car that is less than three years old but No, Mercede expect us to divvy up for the part and repairs; has anyone else had a similar problem (or better resolution?!).

If I were in your position I would tell the dealer in no uncertain terms to stop being so silly, sort it and I don't expect a bill. If MBUK are being silly I expect them to argue it, not me.

It is covered by warranty, everything is. Even bulbs under 3 yrs are arguably a warranty item as they should last longer than that. Aside from tyres and brakes I have NEVER paid a penny to fix anything on a merc < 3 years old and neither should you. Unless they are saying you damaged the springs in some way, they have failed prematurely and so, by anyones definition are covered. It's not open to argument so I don't understand what they are telling you. My car is 4 years and 60k old. MB recently paid 70% towards the cost of replacing a diff seal despite my after market warranty firm refusing it as a wear and tear item. MBUK agreed that it should not have failed, wear or otherwise, at this age and immediately paid up. They also agreed to pay out for an ESP sensor at 3yrs and 2 months old, again as it shouldn't have gone.. and I'm not covered under warranty, you are.

For some reason, it seems that some dealers are just lazy when dealing with these things. They put in a claim and take the first answer the computer spews out. Others, like mine, fight tooth and nail for the customer. I have had things refused on occasion but the service guy has always said the same thing, "Ignore it, I'll sort them out", and he has.

Car firms can get silly from time to time. I had Audi refuse to pay out for an alarm because I hadn't had the car serviced for 18 months. This despite the service indicator saying it still wasn't due yet. And, as I asked them, what difference would it have made anyway? They don't service the alarm after all. Faced with an unwinnable argument, they backed down, reinstated my warranty and fixed the alarm.

Don't stand for any silliness or else find another dealer.
