Cruise control refuses to switch on

Hi,
I own a e320cdi which has developed a fault with the cc actuation.
:-? The cc system will not activate after initial start-up. The puzzling part of the problem is that the cc system will activate after a re-start. I quite frequently
make a 100 mile motorway journey and find that the cc will not set. On the return journey the same day the cc for some reason will set and behaves itself perfecly. I have 2 weeks warranty remaining on the vehicle and I would like to resolve this problem befoer this expires.
The warranty is not MB so I would like to identify the likely problem before talking to the insurer.
Has anyone encountered a similar problem?

On a brighter note the car is brilliant. I owned a 300TE for 12 years and the petrol consumption was starting to bite at 23-27 a gallon. The 320 deisel has stunning power when required and averages 32-40 a gallon. No doubt I'll need the saving on fuel to pay for merc parts.

does the car think its in speedtronic mode when cc not working? Push the lever up and see if it set a limit.

quite often simple things like worn tyres, low tyre pressure etc.

Inittial mornign start = cold tyres, one at (say) 5psi under the rest. that tyre is 'smaller' than the rest. CC doesnt like this, shuts off.

That afternoon, re-start, warm tyres, all at higher pressure, the one with lower pressure is close enough to the rest for CC to accept it...

Thanks for your suggestions. Tested LIM today and it works fine. I will check tyre pressures tomorrow. The cc worked fine today but was unable to check from initial start.
