"Emissions defeat device" claims

I notice there is suddenly a flurry of firms offering to represent MB owners in a class action, to see if it can be shown MB installed so-called defeat devices on their Bluetec diesel vehicles.

I know there was a recent High Court ruling on the VW class action but that only seems to have held there is a POTENTIAL case to be answered and the action may progress. Personally I will wait until a VW owned in the UK gets compensation before I get too excited.

Oh, and one of the firms apparently admitted they wanted 50% of any payout as it was on a no-win, no-fee basis.

Well the lawyers have to get rich from someone now the mis-selling has gone past it’s due date and there are so few accidents due to everyone being stuck at home. Vultures!

If the courts find in favour of this action, I see no reason why individual MB owners cant then make their own claim?

Someone mentioned somewhere that you have to be careful of these no win, no fee cases as you can still get stuffed for costs/expenses somehow?

That's exactly my thinking. Based on the VW experience, it could take years for this to make its way through the courts with barristers for both sides earning loads of fees along the way. If the MB case is ever decided in the High Court it should be relatively easy to pursue an individual case through the small claims procedure, citing the decision in a higher court.

A company we used to own in the US (not me personally just the company I work for) were class action experts, the Mercedes bluetec class action was dropped after only 6 months there due to how MB had done their testing, so no cheat in the software like VW, but they did admit that it seemed to be an unfair test and revised maps as a whole to give a more accurate result
