Enging Oil level in CLK230

:?: On two occasions now I have had my CLK serviced. The services were carried out by two garages. Both services involved oil changes. When I check the oil level on the dip stick the level was 1/3 the distance between min and max above the min level. The second time the level was half was between the min and max. On both occasions I was charged for 6L of oil. I have checked in my car manual and the engine oil capacity is specified as 5.6L. There is no oil leak and I am not burning oil.

The first garage apologised and filled the sump until the level was just below the max on the dip stick.

On the second occasion, the service dept told me that, it is their policy to only fill to half between max and min on the dip stick as the oil expands and sets off the HI OIL warning. When questioned why I was charged for 6L of oil, I was told that 5.6L was used and that I should expect this quantity to show the level of half way between max and min. on the dip stick.

If the manual says that the engine oil capacity is 5.6L, should I expect the level on the dip stick to be at or very near MAX or as the garage says, in the middle?

If there is expansion as the oil heats up, would this not have been taken into account by the Mercedes engineers when they set the MAX level on the dip stick?

If someone can clarify this I?d be grateful.
