ML 270 Tailgate open but lock locked!

Had the 2002 car for 9 months and first real problem:

Despite the tailgate being open the tailgate locking mechanism is locked and bangs against catch when attempting to close.

The lock is normally operated with the remote. However there is a door handle on the inside of the tailgate which is also not able to release the lock.

I have tried spraying with WD40 and leaving overnight; repeatedly unlocking, locking with the remote central locking and the in-car locking/unlocking button in trying to release the lock but with no success.

Any suggestions/ help appreciated

If you study the lock on the door, and the keep on the car you should see how the lock engages, normally it is possible by turning the handle and easing out the locking catch, there could be a satfy pin the needs depressing at the same time.. If you cant solve it I am sure that your MB garage will open it while you wait.

Go to your car,enter to the right year, in the center line you will see rear door, then locking.

Yes Malcolm is poorly. He's 2 weeks into 6 weeks of daily radiotherapy and when he's not at the hospital he's trying to finish his house renovation.
