Mmmm indeed.

If you look at Autotrader, you can pick up a 250TD Elegance (I assume your car is auto) from £2750 upwards with the majority at about £4k.

Parkers says a sale from an indy dealer with 80k on the clock is £5k so allowing for the fact it's done 2.5x that mileage, I guess 3K is probably a good price.

HOWEVER

For what it's worth, I'd show the insurer what you have to pay for one by getting them to run through an Autotrader search and they might realise the premium Merc diesel estates command. I'd push for £4K and settle for £3K, get your old car back and get it fixed. If the insurer insist on keeping it, find out which scrappy gets it and buy from them.

Good luck.

Thank you Seeker for your post. It is a manual not an auto and what is the premium merc diesel estate command?
They are valuing the repair at £3093.20 and market value as £2000 which I think is taking the p*** but I dont know what to do now

I think that £2000 would get you a manual "classic" saloon, private sale with the sort of miles you're talking about.

Add £400-£500 for an auto and the same for it being an estate.

What you need is for a reputable 'indy' dealer to write to you on some nice letter-headed paper saying that in their experience to get like for like you going to have to spend £3-4k.
