Newbie - ML tiptronic 3rd gear flaring

Hi there, I'm new to this site but any assistance anyone can provide on this mini saga would be very much appreciated, details as follows :-

Spec:-
2002 ML CDI tiptronic , 75k miles, FmbSH.

Problem:-

Going into 3rd gear the rev counter jumps regulary (but not always) to 3000rpm's briefly (couple of seconds) before it engages (I believe this is called flaring ?). I've noticed on heavy throttle/acceleration or gradient the rpm's can increase to over 3500rpm's before engaging. The 1st & 2nd gears are fine , 4th & 5th gears appear to engage slighty belatedly but nothing major & at 70 mph the rpms are approx 2400 rpm which is what I'd expect. Diagnostic computer test gives the following error :-

4500 code : The transmission has an impermissible transmission ratio. (which I've googled with no joy).

N.B I've expermiented driving in manual mode thru all gear ranges but unable to reproduce.

History :-

I've had the above car for over 2 years & its been excellent, but 2 months ago it broke down with no drive, MB dealer found excess metal filings/swarf in gearbox & recommended new gearbox/valve body (approx £4K repair incl labour). Therefore opted to go for 2nd hand gearbox/torque converter (from an ML 2003 tip) via breakersyard (retrospectively a risk as I've now found out after reading some of this forums posts). This 'used' gearbox was installed about 4 weeks ago by an MB specialist- initially the gears only worked upto 2nd gear & then would stick in 2nd, however this was duely resolved & I've been driving this car ever since (approx 1500 miles driven) with this 3rd gear issue as stated above.

Recommendations to date :-

I've spoken to various MB specialists/dealers in the last few weeks on the above fault (error code), all conflicting, one says replace the valve body/sensor another recommends a gearbox overhaul & another says it could be the ecu - so presently I'm pretty confused.

If anyone has any ideas on this problem/resolution or way forward in getting this sorted then please advise.
