There is a report on the internet about a S600 Pulman which was bought for £194,000 and then sold by the finance company 10 months later for £59,900:shock:

It was also significant, in the Court's view, that no proper expert evidence was produced by either party, especially Automobile. In the original order for directions the judge had granted permission for such evidence to be adduced and Automobile had sought at one point to rely on a letter from Mr Loughran, who had originally sold the Pullman to Lombard. Mr Loughran stated that in his view and in light of market conditions, £150,000 would have been a fair resale price. This was not accepted by the trial judge to be independent expert evidence, and was rejected as being incorrect in any event. Lord Justice Rix stressed the importance in his judgment of expert evidence in cases such as these and noted that the "failure to mitigate is ordinarily established by the opinion of an expert as to the inadequacy of the price obtained on the sale of a relevant asset".

I would guess that the Mr. Loughran could be the dealer William Loughran. Perhaps Automobile should've asked for an expert from an MB dealer, or the coachbuilder to help back their case. Although the rest of the article seems to say that it might not've made any difference, as Lombard were within their rights to reclaim and sell the car.

Ahh; Now there is the problem. Those members who were in the motor trade years and years ago can recall the finance companies reps "placing" cars that were "snatched back" and what used to go on.

Now, as I understand it, the finance Companies inform trade dealers on their list of whats avilable and wait for bids, now, what is a standard, say, S600 worth against one with all the toys or a specialist vehicle?

Its the same with houses; morgage companies selling them for "peanuts" and coming back to the previous owner for the difference.

Lombard have the right to sell the goods, its in the contract, no question, but, did they realise the maximum value for the goods? Who is expected to make up the shortfall?

Or was the low resale price because it had been 'serviced' by the same dealer who took such good care of your S-Class , Robert ?

A Match and Despatch man then;)

Complaints; Complaints:

The coffin is: too big, too small, the wrong colour, not polished enough, was it 2nd hand?

The grave was ; not deep enough, too shallow, on a slope, no view, too close to the road, out in the open.

And that was the customers, the relations were even worse:(

You cannot please all the people all of the time:shock:

Weddings!! The dreaded phrase "its my big day". There is nothing less useful than the driver of the car and the father of the bride an hour before the "off".

To see that many women "focused" is not a sight for the faint hearted!

I used to video record weddings for a while . After several years of doing it I became jaded to the point that if I never go to another one , it will be too soon .
