Few weeks ago I was in the process of overtaking two vehicles who were travelling one behind another, on a section of dual carriage way.

Just as I started passing the following car, the driver indicated and pulled out to overtake the one in front, failing to spot me, and although I attempted to brake and swerve it all happened too soon and both our cars made contact.

I managed to avoid being pushed in to the central reservation and kept control of my car while the other driver lost control (obviously not expecting anything) and spun off up the road. My car had damaged to the front nearside corner while the other vehicle was badly damaged after making contact with the barriers. Luckily nobody was injured.

When the police arrived, I was busy picking up debris from the road and they spoke to other people first, including an elderly couple who witnessed the accident, who said they thought I was speeding as I'd also passed them, which I of course deny. This lead to the other driver and myself both being charged, me with driving without due care and consideration as they believe I was travelling too fast.

My question is where do I stand on this one, as the witnesses say I was speeding but I don't believe the police have any proof. Although they did try to blame skid marks further back down the road on me, my car has fully functional ABS and judging by the width of said marks, they were left by a lorry or similar.

Help much appreciated. My insurers wont help me due to the couple's statement!

When the police attend an accident,and are unclear what has happened,all of the drivers are cautioned so that they can proscecuted at a later stage. It is a formality

We had the identical situation a while back and nothing happened.

I had a nasty accident a few years back and was told to present my docs at teh local cop shop. I explained to the desk officer what had happened and he said "as long as there were no witnesses you'll be let off", unfortunately there were and I got points (driving without due care) and a fine - although not a very big one. In that case though, I was in the wrong, not intentionally I hasten to add, I just got it wrong.

In your case, as Malcolm says, its easier for them to charge everyone and then sort the mess out afterwards. They won't be able to take the advice of a witness that you were speeding as they will have no proof and any decent lawer would get that thrown out. My personal opinion is that they'll drop it all and then you'll have the usual problem of convincing the insurance company that it wasn't your fault. Unless you have witnesses to say he pulled into you and not the other way around I expect they call it knock-for-knock.

My lawyer said the simple fact that I crashed proved i wasn't paying suitable attention to the road and I'd be found guilty if it went to trial, so he advised a plea of guilty, which I did. My lawyer never turned up and the guy I was appointed explained it completely wrong to the judge which made it sound even worse than it was (said I was overtaking on a street, not dual carriageway plus few other things). I was too scared to even correct him in case I was done for contempt or something! :D lol

Judging by the reaction of the Crown's representative to my plea, pretty certain they were expecting it to be thrown out, so with hindsight (spelling?) I would have got a different lawyer and pleaded not guilty!

6 points and £100 fine in the end! Nothing really, considering how harsh the judge was on some other motoring offences! eek!

But life is all about learning from mistakes is it not. :rolleyes:
