Legal Advice: Mercedes Damaged My E270

confused: Hi fellow Merc owners,

Need some advice. I recently took my E270 '03 into Mercedes in North london for a inspection and vallet. The car has had some paint flaking which the head paint guy took pictures of. When I returned to pick up my car I noticed a graze on the bumper that is clearly visible.
I pointed this out to te service manage and they said they would get back to me. When the paint technician was taking pictures of the flaking paint he happened to take pictures of where the grazing has occured.

Therefore, I told Mercedes that they their own photographic proof that the damage occured in their workshop. I have since called the Centre manager and he said he will come back to me re: this matter. Technically they have caused criminal damage to my car through wrecklessness. Does anyone know what I can to regarding getting them to repair the damage they have done ???

If the centre manager doesn't get back to you within a couple of days , then the best way forward is to acertain who's the most senior person at the site, then put your complaint in writing (with photos) telling them that the damage occurred whilst in their care and seeking a repair and giving say seven days for them to confirm they will repair
FOC . If they don't respond, then write again, telling them you will get the repair done elsewhere, and pursue them through the small claims court for the cost. Use recorded delivery , and keep a note of what said what and when you speak by phone

This should move things on

Err...I think you mean 'accidental' damage......'criminal' damage would be a case where someone 'intentionally' causes damage...........

Anyway, Dont you think it's a tad premature,at this stage to be asking how you can .."get them to repair the damage".. when the manager has already said that he will get back to you and, presumably, is investigating the situation?

I can only agree completely with Pano, on this. MB are OK on this front

Be nice same happened to my slk when in for service I spoke to the manager very nicely and the car was fixed next day no probs(4"-5" dent) if you go in raving no matter how angry you feel, you are on to a loser straight away.
I had no photgraphic proof etc but they agreed to repair it no problem as I was reasonable and explained how it could only have happened there without flying off the handle!!!

Good woerds by Shambolic, when you are dealing with anyone that has more money than you BE NICE that goes for insurance companies and manufactures, you will always get more.

you are going a bit overboard with your accusations, aren't you...

They had an accident, they said you'll get it sorted. What more do you want?
Jumping the gun accusing them of being criminals isn't going to get you anywhere.
Talk to them again with a smile, and as others have said, you are more likely to get it sorted amicably.

Chances are it wasn't even them. More likely it was done by a customer in their car park and they didn't know anything about it until you reported it. However, it's still their responsibility and I'd be very surprised if they didn't call you back in a few days and ask you to bring the car in for repair. That's what they normally do.

My wifes aunt had her new clk cabrio in for a rattle. Rattle fixed but they've slightly ripped the roof. No question, no argument, no suggestion of a repair, new roof on order at their expense - (£5k worth apparently).

As Malcolm says, they are normally pretty good about these things.
