Mercedes benz warranty/fianance question {Urgent!!!}

Hi there, I am really hoping someone can help me.

I purchased a 08 plate mercedes earlier this month (on finance over 4 years) from a Mercedes benz dealership.

Now the issue arises with the warranty. When buying the car I told them I would "think" about the warranty which would cost an extra £1295.99 (over 4 years costing me approx 500 quid a year). However having a chat with family members we decided we did not want the warranty and we went to the dealership a day after we purchased the car and talked to the business manager and notified him we would not be interested in taking on the warranty. He said it was fine, as it was optional and entirely my decision.

When I picked the car up, I signed the paperwork, assuming that everything was fine and the warranty was not included in the price (I was literally there a couple of days ago explaining I didnt want it). I have now had the car for over a week or so . I am only 23 and probably quite naive so was rather excited about picking the car up. However I was shocked when I looked over the paperwork to see the total cash price of the vehicle includes the price of the warranty. :(

I gave the business manager a ring and he told me that he could do nothing about it now as it had been sent to mercedes benz finance and basically I could not cancel it, even though I had specifically said I did not want the warranty.

Can anyone provide any advice on this? Do I have a right to cancel, if so would it be worth me ringing Mercedes benz finance in milton keynes? :confused:

I have not made any payments thus far, they are due around the 8th june.

Please help its very urgent!

What have you actually paid for? All MBs have a three year warranty. Is it a 4th year warranty?
And I wonder why didn't you think about this before you actually took the car?

Anyway, I suspect the business manager told you what you wanted to hear when you went back fisrt time. and now he's made his commission on your £1300 not interested in handing any of it back.
To be fair, you've not exactly helped yourself (did you not check the sales invoice and finance paperwork on this purchase?), but a letter sent recorded delivery to the dealer principal there stating the facts and who said what and firmly but politely telling them you want the warranty cancelling will be a good starting point .

MB in MK will only send you there anyway at this stage - they;ll only get involved once it escaltes from there.
After all, the current issue is with the dealer and his staff after all, not MB a MK.

Let us know how you get on. Your niaveity isn't an excuse for the dealer tucking you up

Complain to MB head office if the dealer says he cannot help.
Escalate the problem until someone is willing to step in.

I have a feeling that any extended warranties, whether on a toaster or a Mercedes car, have a cooling off period of about 16 days compulsorily by law, but I may be wrong. If I am not wrong, then they acted unlawfully by not presenting you with that option.

They've also mislead their customer too. The vehicle the OP purchased was a 2008 model and it was sold assumably as an approved used car. The car would have had 2 years manufacturers warranty.

The dealership haven't sold 4 years cover, but an additional 2 years.

I work in a bank and we have something called "TCF" and that is treating customers fairly. Part of this is making the deal transparent, easy to understand and not to mislead customers. This is an FSA principle and finance/warranties come under the FSA so the OP should quote this in any correspondence with them.

I'd be asking the following points

1) Its 1yr old, it therefore has 2years manufacturers cover. There is no need for the garage to even try and sell additional cover
2) The OP (customer) agreed orally to purchase the vehicle without this supposed cover but it was put into the deal.
3) The paperwork was not adequately explained before signing, this is against TCF, its misleading and potentially fraudulent. The paperwork went against the original deal too.
4) What MB will do to rectify this. Write politely but not arrogantly and do not yet threaten legal action, financial obundasman, getting "What Car" involved etc. Save that for later.

Please note that approved used cars have a 30day 1000 mile (whatever comes first) no quiblle return-i.e. cooling off period in which you can return the car/finance etc and you can start again with a dealership that will take your business seriously.

I agree with ST4---and in particular the last paragraph--Go to the person you dealt with and just be polite--take all the paperwork park the car as close as poss to the front door of the showroom lock it and quote the cooling off period offer him the keys back and that you wish to now just cancell the sale and leave the car there unless the sales paperwork is re-written to your satisfaction ?
It will be done there and then -or they will lose a sale!

When did you actually sign the documents?

The cooling off period is normally 14-16 days. If you are still within this timescale go back to the dealership with your documents and insist (politely but firmly!) that they cancel the cover.

Within the documentation there will be details of how & who to complain to if you are dissatisfied, as well as details of the Financial Services Authority (FSA) who are the Regulator of financial services companies.

The dealers get quite a nice wedge of commission on warranty sales and I have a nasty feeling that the salesperson is being economical with the truth as the are thinking of their bonus!

Unfortunately the signed contract will supercede the verbal agreement/contract with MB. However, if you are still within the cooling off period then you should be able to change your mind.

When I was sent the paperwork under the disclosure rules before the trial it showed the finance company paid MB commission of about £600 on my car, the commission on any "extra" items will be more.

Does your Order Form show anything like "the Terms and Conditions will be sent within 7 days"?

If so, the T&C are unenforceable as they were not given at the time of the signing of the Contract.

One has to be reasonable, as I have been these past years.

Keep notes on who you speak to, where and when and what was said and if possible in writing.

What did you acutely buy? Or what did you think you were buying?
