Sorry to hear of this and shame as that was a lovely looking CLS!

I weave around the road to avoid even the slightest of imperfections as I like to do my best to try not to subject the car to such things. However, sometimes its unavoidable and to be honest the councils should be held responsible. I hope you get the outcome you're after!

Thanks Mark I do feel very lucky in the way things went, the oncoming car was a builder who turned round and helped me get out and he thought at one point when I steered right to get off the grass I might end up coming back across, does not bare thinking about really

That looks like a rather tricky claim against the Council. It wasn't the Pothole that seems to have caused the damage it was the tree. Good luck with that :(

I gather you have had some fun of your own fella, is it repairable, will the insurance spend the money on it ? I hope they will, thats Malcs old one isnt it

Very sorry to hear this Mr Hatt... the real consolation is that no matter how nice it was, a car is a replaceable but people aren't. I hope you're not too shook up now and can think about enjoying the search for a replacement.

btw: Nowadays, even if you're fully insured to cover everything, when your renewal premium arrives it goes up as if by magic - the (expletive) bookies who run the insurance trade (well, it's no profession, is it?) have worked out that as you had an accident once you're a bigger risk even if you've been accident free forever! Your claim as normal, should of course include uninsured losses. I saw an article (sorry can't remember where) but it seems the innocent party included a figure to cover 3 x years increase in his insurance premium. I believe it went to court and he won.

Its a close to cut and dried as it can be because local Plod had reported another car hitting it two weeks before and no action was taken so they ordered Highways to attend that night and do the job, Council are well in breach apparently, how bout that for a result.
And for the record my insurance company are one of the better ones so I got a valuation well above book due to £11k of factory options when the car was new, bought it back for £500, paid £450 excess and got a bank transfer of £4600 this morning, long as the council claim works out the excess will be back soon too :):):)

Yeah, just got to decide what to look at next, I have an old Navara that I will bumb around in for now and would love a CLS shooting brake so gotta start combing the salvage yards for something thats a reasonable rebuild like the old CLS

Perhaps people see us as being a bit sad but that 15 year old Merc made me smile every time I got in it, I used to spend hours cleaning it each week, it will be missed but perhaps time to look at an ML due to our crap roads now:(
An ML wont make any difference, you would still have veered off into the ditch.

Oh yeah, the police made them come out immediately and fix it because they had attended a damaged car from the same hole two weeks before and nothing had been done, my insurance comp is straining at the leash to go to town on them kiwi
Blxxdy right too.how much was yr road exise for that privilege . Get a copy of police incident report,especially bit about previous incident .sue for replacement.and all other related expenses .
A few yr ago I wrecked a friends front rim hitting an unlit unmarked resurfacing ramp in dorset .thought I wrecked the car to add insult I got done for 6mph over limit 30 yards down road whilst I was still gathering myself together over it.I sent pictures of ramp about 3,,inch and dead square and rim there was a sign but it could not be seen at night and was 3ft from actual road works ramp.!!!.did they care dtf! £100.and a few points.
So go get em !!!!!


Just reading seems ur having a happy ending ,thats great as above get an allowance for ur likely increased premiums..the "bookies" never pass on that ,if they do plse name provider.

I didn't read it like that - I presume it meant you would still have had to swerve off the grass etc.
Mind you, if you do get a 4WD ML it might be more controllable across grass and potholes!

Thank you fella, insurance solicitors are on, they are the best kind of solicitors because I am not paying them LOL
