Good Afternoon all,

Looking for a reputable specialist speeding solicitor.

My dad has received two speeding tickets, both the same time, date, and seemingly location, but issued as separate NIPs. Beds police adamant that it is two separate offences and will be charged as such. Unfortunately he doesn't have the points to play with.
Both 37 in a 40. He is adamant that the limit was recently reduced (it was it turns out) and signs not visible but who knows. This is why large capacity dash-cams are so essential now.

Yeah heard of him, but no idea who he actually is! Plus i'd imagine £££££!

id be tempted to defend it himself ! its clear the camera is / was faulty at the time and id wager he wont be the only one who was caught by it in the same manner , maybe put it on social media and see if he can drum up some support ??

Not sure if he's a bit far for you but Andrew from AGT Law comes highly recommended on Piston Heads and other motoring sites.

If he's not available in your particular area, he may be able to suggest someone who is?

Quite a bit more reasonable than Nick Freeman (Mr Loophole) too I would imagine...

I presume you mean it was a 40 limit now reduced to 30? Must have been 2 cameras close to each other. I'd be tempted to rush out there and film the road and its apparent lack of signage if your dad is suggesting there were none. Was he not offered a course instead?

Yes you can have points and a course as long as its over 3yrs apart from the last offence.

Hmm some not quite correct information being posted.

He doesnt need a super annuated lawyer!

Firstly there are four different types of speed awareness course. You can sit a second course within three years provided it isnt the same type as before. So if you are speeding on a motorway you will be offered the motorway course assuming your speed is within the tolerances for it. The course for speeding on an A road is different so you could sit that course if caught on an A road within three years of doing the motorway course.

Secondly, there will not be two cameras and it wont be the camera at fault. The charges are laid by a human who it would appear has entered the offence twice. The simple solution is for your father to plead guilty to one and not guilty to the other. He cannot of been speeding twice in the same minute at the exact same location. The second charge will get dropped. Its not the police who make that decision at this stage its the court/cps.

If he has six points or less then he will only receive 3 pts and a band A fine for the one offence. Band A fine is half his weekly pay less 33% for an early guilty plea. If he has nine points then he will become a ‘totter’ and the court will consider a disqualification under the totting up rule (12 pts or more).

If he had been travelling on a genuine emergency which he can prove then he can plead special circumstances. Examples are, rushing someone to a hospital etc. If he is looking at a disqualification then he can plead ‘exceptional hardship’. For this he needs to plead guilty to the one offence and request a court hearing where the court will then listen to the reasons why he should not be disqualified. Losing your home or job is not exceptional hardship (believe it or not) the bar for exceptional hardship is quite high. Basically you have to show that losing your licence will have a significant impact on the lives of others (not you). Examples are, you care for a disabled person or losing your licence would mean others losing their jobs etc. This isnt an exhaustive list and I really dont want to get into a discussion about what is exceptional and what isnt. Basically its up to the defendant to prove it.

(N.b exceptional hardship is a card you can play only once)

The apparent recent change of the limit is not a reasonable excuse. Its up to the driver to be aware of the limit. Often the limit is determined by the spacing of lamp posts not just signage.

It certainly is possible to get "done" by 2 different cameras within the same minute on a road near where I live. In fact you could get flashed by 3 cameras in a minute. I know idiots who this has happened to! I would be going back to the scene to ensure that there aren't 2 different cameras in close proximity to each other.

Also if there are no signs or warnings that the limit has been changed, how are road users supposed to know.

I made a mistake with my original post, he was doing 37 in a 30 zone, which was until recently a 40. The camera(s?) are average cameras covering the same zone.

So from what we can deduce so far, the village he drove through now has blanket ANPR enforced average speed cameras, with several cameras dotted around the village to supposedly catch you driving through the village overspeed, with road types/furniture which wouldn't immediately be clear to be a 30 by deduction. (previously being a 40).

No speed school possible, he did one last year. Our concern is, points wise, if he tries to defend himself, and he gets a difficult magistrate, they could give him maximum 4? points for each offence, leaving him with little leeway on his license. Thank you all for your input so far... i will keep you posted, and will most likely take a look at those suggested above. Thanks!
