Transmission Fluid Black

E320 CDi not changing gear properly, and car not moving beyond 40 mph or 3000 revs.
I have recently bought the car and the previous owner says he never changed the transmission fluid or filter during previous 7 years. On checking, the transmission fluid is black. Could this be causing the above problem.

It wont be helping, the fluid should be a nice cherry colour, it would be worth while getting the fluid and filter changed.

Thanks for replying Huey. The temperature on the dial is an extraordinary minus 38 degrees. Have you ever heard of this before. Could some sensor be picking up on this and not allow the car to exceed 40 mph.

You need the fault codes read, would guess the air mass sensor has failed......
