Quite incidentally they changed the company name the day my letter to them arrived and subsequently refused it.

I mentioned the TV program "Can't Pay, We'll Take It Away' earlier. The name change ploy has featured in about half the episodes I've seen - the occupants try to prevent the bailiffs from seizing goods etc - but the first thing they do is look around and 1) if they still have the old name on display they're knackered and 2) they tell them they must see the official change/registration papers or they will proceed. They usually find it's nothing more than a paper exercise - frequently their invoices (especially on computer printers etc) still have the old name and address. It's great when the bailiffs (who are usually bigger than the proprietors!) shut the door and stick seizure notices on things and clamp vehicles - they immediately check via their own office if they belong to the company.

And there it goes again!! After a weekend of perfect running, long driving, turbo works fantastically! My lord does that car move!! And not even a puff of steam in the cold air!

But pulling into my drive, what happens?? Kaboom, clouds of thick smoke, strong burning smell and the cars parked up again ready to go back to the garage!

****** hell, think a trip to we buy any car is looking quite likely!!
Sorry to hear your bad news. My worst nightmare with second hand cars. I'm looking at cars this year, and knowing my luck I'll find a wreck. What is the latest with the car now? Sorry if you have mentioned this, but what is the year of your c220d?

It’s not looking good and I think it will be up for sale as spares or repairs when I get it back.
Today I was on my way to take it back to the mechanic, smoke immediately billowed out all the way, then I was going up hill and the engine seemed to cut out and restart again but moving very slowly. I imagine that was limp mode. I got it up the hill and onto a side road the stench of burning oil was over powering!!
It was quite funny when I stopped because when I got out there were 2 ladies having a cuppa watching looking gobsmacked as a car emerged from a huge ball of smoke!
AA came after an hour and the swine of a car was perfect! Not a puff and drove beautifully.
It’s back at the mechanics now.

I think there is an underlying issue here and regardless if t is something or nothing and mechanic puts it right, I have totally lost faith in the car. I can’t imagine I would feel safe taking it on a long trip, it conked out twice just going up the road!

But I’ve not given up on having a merc and hopefully I can get a lease arranged in the in car few months.

I’ll let you know what it turned out to be this time round.

If I can find out who they ownership is I’d definitely take it further.

That's your first shadow, find out the name/s of the owners and jointly name them and the company on any summons and if you can find any connection whatsoever their wives/partners and homes.
The "nest" is always the best place to start.
Please take on board that the above is a simplistic observation not concise legal advice.
As a LIP you can get away with all sorts.

*Litigant in Person.

That’s definitely worth a go, problem is I’m not even sure who they are except for an “A Hussain” Autotrader however told me I can make a request for the information for the details they hold if I can obtain a ccj. Could be worth a crack.

I think you mean Court order, you could write to Autotrader asking for the information to be released under section 35.2 DPA, exemptions for data controllers which allows them to release data for the purposes of legal action.

You could contact your local County Court and ask for a form it will be n something or other to ask the Court to issue a Court order to force Autotrader to release details, there will be a fee.

You could also use personal media facebook twitter etc to elicit some names they are bound to have upset others and possibly have CCJ's listed against them.

Or and best of all you could look to see if you have legal expenses insurance on any Insurance policy you may have, it also comes with some Bank accounts these days did you pay anything with credit card etc etc.....
Then someone one else can do it for you .

There are many ways to approach these matters that only expire when they have got nothing and no prospects.

That is really good, the chap at Auto Trader was helpful but didn’t explain it like that.
I’m going to have a look into this today.
I checked all over social media and not a dickie bird unfortunately.
But I’ll contact our county court today and ask about getting this information release order.
Thanks for the heads up.

Can I just ask, would one of these private extended warranties have covered this?

I had a look for a warranty to purchase seperately, warrantywise etc.. however the mileage was too high,it’s on 145,500 there or there abouts.

I see, probably makes sense, I bet there are a few things to watch out for in the small print?

Definitely will be, best I could get was AA parts cover but that only goes up to £500 and my parts cover only kicks in today. Bit late really

They're not cheap, just did one online and it came back at £800 for the year, that is without contributions.

You would have to read the small print but I think some (at least) rule out claims so early in the warranty period there is then the vexed question of wear and tear as even things that go pop can have there failure rooted in wear and tear.

I don't know anyone that has ever taken one out, and if purchased at a garage just use theirs.

Thanks, but I repeat my suggestion you look to see if you have any legal expenses insurance.

When I looked around a year or so ago, the best value policy seemed to be the Warrantywise offering from motor journalist Quentin Willson. But... you takes your choice and oh boy - do you pay yer money! I did my sums and decided I was better off being prepared to pay for a fairly serious problem and save the money if nothing happened. In the end I bought an approved MB car with 1 x year of warranty (and never needed to claim anything!).

The other thing is, when you phone for a quote if you don't buy a policy there and then they will call you back repeatedly - really repeatedly!

Just heard back, it’s the fuel injectors now! Quoted at £1100. Not a bad price but I’m going to cut my losses and sell up. I think it’s genuinely a bad car and even if I did do the repair, what’s to say I won’t drive it out and 2 days later something else happens.

I’m going to pick it up shortly but quite dreading driving back with the smoke. If I used a bottle of wynns smoke away additive would that keep it clear to get me home?

Do you think this was a case of a car not being looked after?? Sorry to hear
