As your specialist is liaising with the selling dealer , make sure you read up on your buying rights , and make sure that the selling dealer acknowledges in email that they "agree" with the specialists assessment and are "going" to pay for him to do the work . You could easily see some of these costs getting out of hand and the original dealer trying to back off any verbal promises .

Well we have the culprit.

Turbo leaking oil into the inter cooler.
How I drove that car to the garage without being pulled over I’ll never know! It was creating a smog!!

A new turbo recommended, he said they could remove and clean the turbo but not sure how bad the leakage is.

The dealer: can’t even be bothered to pick up the phone!

So what on earth should I do? Repair myself and chase the dealer for payment and trading standards and small claims if necessary.
Their “warranty” is through themselves so even if they did offer to repair, wha type of job would they do! I really do not know if I can trust them!

The garage are getting a price for a new turbo, if it’s telephone numbers I’m pretty buggered! And checking the turbo quote sites, none are giving a quote so I’m imagining quite a hefty price for this car!

Christ what a mess! Don’t think it’s going for that service on Wednesday now!!

Speak to The Turbo Centre in Wakefield. http://www.theturbocentre.co.uk/
They offer rebuilds/exchange service and were excellent with my Defender when I had it.

Wow! 1580 plus vat!! I could weep! It looks as though the dealer is going to be a small claims case! Numerous calls emails and not a dickie bird!
What a mess!! Been there before and I’m here again!

I can recommend Universal Turbos Ltd, Fordingbridge 01452 656900, they supplied a replacement for mine S Class W220 approx £600 twelve months ago, mine had totally disintergrated on the M3 with a superb smoke screen. This company is reckomended by most garages in this area Bournemouth Dorset......good luck with the repair.

Looks like you're going to have to 'doorstep' them to try to get some action, but...it's not looking good. What mileage is on the car? Do you think it's genuine? Any MB service history?

Nevertheless, really sorry to hear of your woes with this car. Hopefully the seller will do the right thing.

I bought a turbo cartridge for my 2004 c220 from Ebay around £80.00 Simple job runs like new, must be over two years ago now. john.

Well I bit the bullet and said do it! I’m going to send the invoice to the dealer and request payment in full within 7 days. I’ve also found feedback in their auto trader profile with people having bought cars and gone wrong almost instantly. One another turbo failure.

I’ll also be contacting west yorks trading standards (dealer is based there) and getting the full legal spiel. I’ve got photos & videos etc.. It was also not sold as advertised. Full MBSH yes up to 2013!! 122k

Aside from this major issue it doesn’t appear to be a dud car so hopefully after this inconvenience, the car should be a keeper and I managed to get a service thrown in also so I can get a proper warranty for peace of mind if any nasty shock happens again.

I shall let you know how it goes once it returns!!

Thanks for all the help & advice thus far everyone.

Probably the only way ahead now is to write the dealer with a copy of the quote, giving him a reasonable time to respond, and making it clear that the absence of a response will presume his agreement to pay as quoted, stating Court consequences otherwise.

Having been down this route a number of times, I wouldn't bother with Trading Standards. Despite the hype they are often toothless tigers. An immediate CCJ procedure on failure to pay by due date is the best way forward. You already have a clear record of the dealer trying to dodge the issue. Using a County Court is now an online procedure. If the dealer does not respond to the court as specified you have a virtual automatic judgement, and you can claim daily interest on the stated sum.

I know and I have, I was even prepared to let them take the car back so their own inspection, do whatever they needed to do, however they won’t speak to me. I’ve tried on random numbers they won’t speak to me. “I’ll call you back in 10 minutes” never happens! Promised a call back last night, nothing, text messages, emails through the Autotrader portal as that’s the only way of emailing. Not a thing! I’ve logged every call time and screen shots of history. They won’t play ball, and someone else’s review left is identical to what’s happening to me.

They have no intention whatsoever of honouring any warranty and I had to act quickly as I desperately need the car back on the road. I’ve got until Jan 13th with my other car before the insurance runs out on it and I’ve also got a clutch problem and a slow puncture on that one.

I gave them every opportunity possible to work things out but they just will not play ball. It’s all very sad.

If they don't pay by your specified "due date" then start proceedings - frequent;y in such case, the seller doesn't turn up/respond to the court so you'll get judgment. If you then immediately upgrade your claim to the High Court, they take over collection of your debt (you have to pay a fee which added to the debt so they collect that as well).

The sellers will then find it's not so easy to ignore bailiffs who are commanded by the High Court to collect cash or confiscate goods to the value of the debt and that is the only acceptable solution they will accept - the TV series "Can't Pay - We'll Take it Away" shows exactly what happens.

Fingers crossed for you... the seller still just might come clean and settle.

Thank you. I’m definitely sticking to my guns with this one. I’ll be 110% amicable with them but there’s no way I’m budging on this.

I think & hope I should have the law on my side with this one but I’ll be very well prepared if it does get to small claims.

Wow! No DPF also!! So I was sold an illegal car to boot! I got an aftermarket one for £400 so that’s the bill up to £2400!!

Of course it’s a civil issue but the car was sold with an illegal issue also! Is there any possibility of bringing the police into this now?

I’ve attached a few images of a truly horrendous removal of the DPF! Even the garage said it looks like a home job!!

I think so also, now this was an issue they must have been fully aware of! Yet still sold the car! What b@stards!
I think the Police will just refer you to Trading Standards.
